COURT DECISION


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Frank Haswell
#23-CM-0036

A decision was reached in the above case on the 20th day of May, 2023.


Firstly, I'd like to thank the parties for their patience in this matter. The Defense made a Motion for Dismissal on the 15th of April 2023. The Defense is looking to dismiss this case because they believe the prosecution has not met the burden of proof in this case. On the 15th of April 2023, I made a verdict which made all contents of the briefcase Inadmissible as the court believes that Frank Haswell was illegally arrested in this case.

However, the Briefcase, which he handed to his friend before he was arrested, is still admissible as the court believes is has relevance in the case, giving reason for the case to move forward to trial. Therefore, I will be denying the Motion for Dismissal submitted by the defense and we will be moving forward to trial. As I mentioned beforehand, any evidence regarding contents of the briefcase will be inadmissible. Following this notice, I will be sending out a scheduling tool for trial, please fill it out at your earliest convenience.

A trial date was set on the above case on 21st of May, 2023.


In accordance with the availability reported by both parties in response to the Notice of Scheduling, this trial shall take place at 05:00 PM on the 25th of May, 2023 at Rockford Hills City Hall, Carcer Way, Metro Los Santos, SA.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Frank Haswell

A decision was reached in the above case on the 25th day of May, 2023.


Before the trial, the court has suppressed all mentions of the items found in the briefcase due to a Motion to Supress presented by the Defense.

The defendant, Frank Haswell, was originally charged with WM02- Posession of an Unlicensed Firearm, which he appealed. The prosecution then filed a motion to amend charges, adding the charge of GF16 - Tampering with Evidence, with WF04- Transfer of Illegal Firearms not being able to be pursued to due it being suppressed by the Court. The review of evidence and the trial that was held during the 25/MAY/2023, the court has made the following deliberation and verdict;

On the 18/JAN/2023 Frank haswell was approached by Law enforcement officers who received a 911 Call and were conducting an investigation at LSC. They found Mr. Frank Haswell working on a road accident near LSC with a mask on. Mr. Haswell before the detainment handed a briefcase over to a fellow roadworker, with the man then proceeding to run away. The items found in the briefcase were suppressed, however, the briefcase itself was still found admissible as evidence in this case.

The Prosecution has amended charges to add on GF-16 Tampering with evidence, and argue that Frank Haswell handed the briefcase over specifically to deter an investigation.

The Defense argues that the Prosecution has not estabilished any intent that Mr Haswell intended to interfere in the investigation, and that in this case, the charge GF16 - Tampering should not apply.

The court finds that while it is true that Frank Haswell handed over a briefcase before he was detained/arrested, the prosecution has failed to estabilish the defendant's intention to actually interfere with an investigation.

With the considerations mentioned above, the court has made the following verdict:
  • On the count of GF16 - Tampering with Evidence, I find the defendant, Frank Haswell, not guilty.
  • On the count of WM02 - Posession of an unlicensed firearm, I find the defendant, Frank Haswell, not guilty.


The defendant has been reimbursed for the fees he faced for the charges, and paid for time spent in the San Andreas Department of Corrections. The court appreciates the patience of the parties in this case while the case was being resolved.
