    I assume you are referring to the misdemeanor charge VM03 - Reckless Operation of a Road or Marine Vehicle. The penal code defines this as "Intentional disregard for life and/or property through the operation of a road or marine vehicle". This definition of the charge leaves open the possibility that excessive speed alone can justify this charge, if operating a vehicle at that speed shows a disregard for life and/or property. The definition also allows for other reckless actions while driving to justify this charge, so long as they show a disregard for life and/or property.
