    • The Procedural
      First things first, its the holidays, if it takes 7 days to respond that is quite alright!

      Secondly, I just wish to advise before I file a second inquiry, I have a matter that is more sensitive regarding the LSPD FLD, would the correct procedure be to contact the commanding officers of that department for information, with any special CC requirements?

      Finally, if the LSPD wishes to provide the response to this information request VIA email, please feel free. Government command does not have a more secure means of requesting information of the LSPD, other than via email, however without knowing who to contact, that makes these requests somewhat difficult. It has been the prior position of those in the field to file this request here.
      The Introduction:
      As the Director of the Law Review Committee and unofficial (for Bar Ethics reason, offering personal opinion and not legal advice) Chief Counsel of the San Andreas State Government Special Counsels Office, I require clarification on how PD handles mutual combat within the State of San Andreas. Without this clarification should a Bill land on my desk or the government require a personal opinion regarding it, I would be unable to provide a well thought out personal opinion on the issue.

      The Issue:
      If two consenting individuals wish to engage in a fight, including a fight with snowballs, is it the LSPDs position that they have both violated the penal code, and may subject to arrest. For the context of this question, we are removing any aspect of disruption of the public peace, and just focusing on the act of a fight, boxing match, or snowball fight. (or maybe the LSPD draws a line in the sand, in which case, where is that line?)

      The Context:
      Per my desire to stay up to date on all matters of government operations, I stumbled across a JB Public Inquiry & legislative suggestion from Representative-Elect Kona Kealoha regarding an alleged snowball fight between three parties, that resulted in an arrest of two individuals. According to the inquiry's, it is made clear that uncleared consent was given for this fight and (while no person can reserve the right to request charges not be placed) the individual in question requested they not be arrested as it was, to paraphrase, harmless fun.

      For legal reasons both for the department and the government, I am not looking for the legal position of this incident, only the concept at large.

      The Knot
      The issue that presents itself in this situation as it relates to the government is two fold, first off in my role as Speaker of the LRC, I want to be informed on the larger consequences of any bill that PD, SD, MD, DOC, or Elected representative may bring forth prior to it being brought to the floor for a vote. Secondly, in regards to the Business Licensing Bureau, we offer "EEBL:03 - Fight Club / Combat Sports", as "Licensing Regulations" themselves are not laws, if the government is authorizing individuals to purchase a license for an activity generally regarded as illegal (and for legal reasons, the government provides no position on the matter), then the government has a one way ticket to being sued so far into the pit, we might as well be welcoming the reign of King Ramon Carter.

      Thank you for taking the time to consider this Public Inquiry, the government is painfully aware of how time consuming these requests can be, and we appreciate the department providing their response during the holiday season. We want to wish the whole department a very Happy New Year!

  • Dear Emily Whitehorse,

    If any person does any act that is illegal according to the penal code, then an officer can and should arrest them for it. In the case of a fight between two persons, the applicable penal code entry is GM02 - Battery. The penal code defines this as "Willful and unlawful use of force or violence upon the person of another".

    So if anyone willfully and unlawfully uses force against another person, officers can and should arrest them. If the penal code is violated, there is no guarantee nor expectation that it will be left up to the individuals to press charges against each other, and this can only happen if the officers chose to allow it to happen.

    Whether or not the use of force or violence is unlawful is discretionary. In the case of a licensed and lawfully operating fight club, GM02 would not apply because the force or violence would not be classified as "unlawful". Use of force or violence can be lawful inside a licensed and lawfully operating fight club because that club would have resources on site to ensure that the fight was taking place in a defensible manner, with 3rd parties on scene ready to take action should it be required.
