IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Rachel Pilota
#23-CM-0025

A decision was reached in the above case on the 22nd day of March, 2023.


Given the defendant was arrested, charged, appealed their charges, and due to the relatively lengthy process this case has followed through the San Andreas court systems -- the court finds good cause to dismiss the case with prejudice.

This is not a case that was dismissed prior to receiving the court's full time, attention, and resources. In this case, a motion for discovery was filed wherein the prosecution presented all the evidence used to charge the defendant. Defense counsel challenged the evidence with this court and the Court of Appeals and ultimately partially prevailed. After the case was remanded back to this court, the prosecution filed the current motion to dismiss. The court notes it is the prosecution's burden to prove all charges brought against a defendant and the prosecution's decision to dismiss this case after a ruling from the Court of Appeals is not to be taken lightly. The court takes notice of the fact the motion to dismiss came 10 days after the Superior Court announced the remand and suppressed evidence in accordance with the ruling by the Court of Appeals. As such, the court disagrees with the prosecution that this case has not received "substantive treatment". This case has received all aspects of the legal process other than a public trial, which would have been the next step in this process without the request to dismiss by the prosecution.

The court wishes to thank all parties for their time and patience while this issue was resolved. This case is hereby dismissed with prejudice. The defendant is entitled to reimbursement of the $3,000 fine originally charged, and $15,000 for their time served in the Department of Corrections, for a total of $18,000 . The defendant may receive this compensation and a removal of this charge from any active judge of the State of San Andreas by coming to the court house and requesting said dismissal and reimbursement.
