INDICTMENT


  • THE PROSECUTION CHARGES THAT:
    1. The plaintiff, myself, Aleksandar Pulaski, was repainting his car at Los Santos Customs. Once the vehicle, black Jubilee with license plate DIOR, was out of the paint booth, the Defendant, Ali Valentine, approached the vehicle and opened the trunk of it. The defendant took out the plaintiff's personal laptop from the trunk, currently worth $7,500. Given that the defendant stole a personal item worth more than five thousand dollars, therefore commiting a felony, the plaintiff had full authority to perform a citizen's arrest. The plaintiff pointed a licensed Heavy Pistol towards the defendant's chest and requested the defendant to put his hands up. The defendant had a pistol on his waistline as well. The defendant refused to follow the demands, but chose to return the laptop. Once the laptop was returned, the plaintiff retreated slowly while eyeing the defendant. The plaintiff entered his personal vehicle and turned the engine on. As soon as the plaintiff's firearm was no longer pointed towards the defendant, the defendant, Ali Valentine, together with an accomplice, picked up a Micro SMG from his vehicle and opened fire towards the plaintiff. The plaintiff sustained one gunshot wound in his right arm and one gunshot wounds in his chest, penetrating his diaphragm. The black Jubilee sustained around 30 9mm bullets that penetrated the doors and the windows of the vehicle. The plaintiff managed to escape the scene and call for help. The plaintiff was taken to hospital where he had to take an emergency operation in the Operation Room. The defendant escaped the crime scene. The defendant was identified by officer Billy Drake who was on active mechanics duty before the incident. The defendant was an African American male, wearing only plants and a black t-shirt facial mask. The plaintiff has a bodycam footage of the incident. The prosecution has everything required for the discovery ready to be presented to the court.

A decision was reached in the above case on the 17th day of January, 2023.


I will be denying the Motion for Involuntary Dismissal filed by the defense on January 16th, 2023. The courts waited over three months for the defendant to be arraigned in this case and even then the defendant did not show on this own volition. To get Mr. Valentine in for arraignment it took the Detention and Parole Bureau within the Los Santos County Sheriff's Department to use their own resources to capture him and was even led on a chase by Nicholas Valentine while Ali was in the passenger seat in the process.

I believe it is more than reasonable to allow two weeks for the Prosecution Division to find proper representation taking into account the fact that the prosecutor who brought this case forth is no longer employed by the branch and the Attorney General who filed the formal complaint is no longer in that position.

At this time the court will move forward with this case.

    All Information from the Discovery The bodycam footage as provided by Aleksandar Pulaski of the incident at Los Santos Customs shows a shirtless person wearing a black t-shirt over his face approaching the black Jubilee, opening the trunk and take a laptop out of it. The footage further shows Aleksandar Pulaski taking out a pistol and pointing it to the individual with the demand to return the laptop. It then shows the individual dropping the laptop, after which Aleksandar Pulaski takes the laptop and drives off. Then, automatic gunfire can be heard with gunshots hitting and piercing the vehicle, after which Aleksandar Pulaski drives away before requesting help.

    All Information from the Discovery The CCTV footage of Los Santos Customs at the date and time of the incident shows the Defendant pulling up in his car to a mechanical bay, talking to a mechanic and taking his mask off to identify him as per Los Santos Customs' protocol. The Defendant can then be seeing walking towards a black vehicle parked in another bay, the black Jubilee as seen in evidence exhibit #1, opening the trunk and taking out a laptop, after which the Defendant can be seen being confronted by the owner, Aleksandar Pulaski, who took the laptop back after pulling a gun on the Defendant. When the owner of the black vehicle got back into his vehicle, the CCTV shows the Defendant going into the trunk of their vehicle and pulling out a semi automatic firearm and proceeded to discharge this weapon in LSC towards the black Jubilee and its occupant before getting back into his vehicle and speeding off.

After this confrontation, the Defendant had taken out a machine gun and began firing on the victims' vehicle. The witness statement then also notes the Defendant shooting at an off duty mechanic, severely injuring him in the process.

      • On the date in question, Ali Valentine came into Los Santos Customs to have his vehicle repaired. Whilst I was performinf his repair, I noticed a male pointing a gun at Ali Valentine, due to the fact that Mr Valentine stole his laptop, which I believe was from the Males car. The Male in question pulled out his weapon, and pointed it at Mr Valentine asking him to return the laptop, I quickly step in to descilate the situation, as I didnt manange to identify the Male with the weapon. After I stepped in, the situation, which I believed at the time, came to a halt, and the Male got into his vehicle and was about to leave. As the male was leaving Ali Valentine pulled out a machine gun, and begun firing on the Males vehicle, at that point an off duty mechanic pulled out his gun, and asked Mr Valentine to stop, but unfortunately, Ali Valentine begun firing on the off duty mechanic, bringing him to the ground, at that point I withdrew my weapon and pointed it at Ali Valentine to get him to halt his action. Ali Valentine then jumped into his vehicle and fled the scene.

Analyzing these mugshots shows that the Defendant evidently has abundantly similar features to those as seen in the evidence exhibits as previously provided to the court. in the eyes of the Proseuction, having seen the individual unmasked on the CCTV footage, it leaves no doubt the individual as seen in the footage is indeed the Defendant.

    After that, Billy Drake walked up to me and essentially let me know who was the person that was shooting. His name was Ali Valentine. He injured and shot down one of my employees.

    Any text following ''All Information from the Discovery'', but prior to the actual exhibit should be stricken due to relevance. Opposing party is free to write down and read these statements during trial during his case-in-chief. Discovery should be just the evidence itself without several paragraphs of commentary and interpretation of the evidence.

A decision was reached in the above case on the 28th day of January, 2023.


In relation to the Motion to Suppress filed by the defense on the 25th of Janaury 2023, I will be approving the request to suppress a portion of Exhibit #4 as it constitutes Hearsay. The following will be suppressed an inadmissible, "After that, Billy Drake walked up to me and essentially let me know who was the person that was shooting. His name was Ali Valentine. He injured and shot down one of my employees."

In relation to the request to suppress the commentary of the prosecuting attorneys on All Exhibits, this will be denied as the court believes they are relevant to what the evidence shows and will be allowed to be read during the trial and as the prosecution presents their case-in-chief. The court notes the defenses position on these statements being made on the Motion for Discovery however has made the decision to allow them as they will hold no bearing on the courts ruling until presented by the prosecution at trial.

    (( As you are aware, we have been supplied with an actual video of the incident and would prefer to use that in the in-character evidence for this case, as this is a more objective approach to the situation in general. ))

    Detailed explanation:
    The prosecution notices that on one of the counts of Aggravated Attempted Murder the requirements of the Penal Code were not met given that the victim of the attempted murder did not require hospitalization. With that in mind, we would like to respectfully request the removal of the aggravating circumstance.

    As for the assault with a deadly weapon charge we would like to add, it is shown in the discovery that we have presented that the defendant pulled a weapon out on the footage shown and constituted a factual threat to the life of the victim(s).

PLEA AGREEMENT


  • Pursuant to the case of State of San Andreas v. Ali Valentine; Deputy Attorney General Roderick Marchisio, Deputy Chief Public Defender Cyrus Raven, and the defendant, Ali Valentine, have entered into agreement, the terms of which are as follows;
    1. Current Charges
      1. GM06 - Petty Theft
      2. SF02 - Aggravated Attempted Murder
      3. SF02 - Attempted Murder
      4. VF04 - Felony Public Endangerment
      5. WF03 - Possession of Illegal Firearms/Weapons
      6. GM19 - Face Concealment (b)
      7. WF01 - Assault with a Deadly Weapon
    2. Former Charges
      The state shall pursue the current charges listed above, in place of the original charges listed below:
      1. GF10 - Grand Theft
      2. WM01 - Unlawful Brandishing of a Firearm or Weapon

    3. General Provisions
      • The defendant agrees to plead guilty to the Current Charges outlined in Section I. The State waives the right to pursue the Former Charges outlined in Section II in regards to this particular incident. The defendant will not be required to pay court fees or associated appeal fees.
    4. Waiver of Rights
      • It is CRITICAL that you read this section of the plea agreement thoroughly. By signing this document, the defendant agrees to surrender certain rights, notably; the defendant may not further appeal charges agreed to within this plea bargain.

        This agreement may not be terminated at the discretion of an defendant, the defendant's counsel, nor the prosecution; it may only be terminated by the presiding judge under strict guidelines set forth by the Supreme Court of San Andreas.

        By signing this document, the defendant is pleading guilty to the charges outlined in Section I and these charges may not be challenged at a later date.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Ali Valentine
#22-CM-0057

A decision was reached in the above case on the 6th day of February, 2023.


The case of #22-CM-0057, State of San Andreas v. Ali Valentine has been resolved.

A plea agreement signed by all parties has been accepted by the court. As outlined in the full agreement, the prosecution agrees to no longer pursue the GF10 - Grand Theft and WM01 - Unlawful Brandishing of a Firearm or Weapon in exchange for a guilty plea of GM06 - Petty Theft and the rest of the crimes alleged.

It is with the above considerations that I issue the following verdict:
  • On the count of GM06 - Petty Theft, I find the defendant, Ali Valentine, guilty.
  • On the count of SF02 - Aggravated Attempted Murder, I find the defendant, Ali Valentine, guilty.
  • On the count of SF02 - Attempted Murder, I find the defendant, Ali Valentine, guilty.
