I will be forwarding this case to Attorney General Allgood so he cant find the state adequate representation before proceeding.

Motion to Amend Charges
San Andreas Judicial Branch
Motion to Amend Charges

Honorable Daniels,

  • We the prosecution in the case are requesting an amendment of the charges.
State of San Andreas v. Zeak Cruz
    Assigned Court Case Number: #22-CM-0069
    Requesting Party: Prosecution
Party Members: Roderick Marchisio, Sarah Williams
    Original Charges:
    • VF01 - Evading an Officer
    • SF02 - Murder
    • WF02 - Shooting from a Vehicle (Drive-By) of a Gov. Employee
    • GF03 - Armed Robbery
    Amended Charges:
    • VF01 - Evading an Officer
    • SF02 - Murder
    • WF02 - Shooting from a Vehicle (Drive-By) of a Gov. Employee
    • GF03 - Armed Robbery
    • VF04 - Felony Public Endangerment
    • SF02 - Attempted Murder of a Government Employee
    • SF02 - Attempted Murder of a Government Employee
    • WM01 - Unlawful Brandishing of a Firearm or Weapon
    • NM03 - Unlawful Assembly

    Detailed explanation:

The Prosecution notes that as per the evidence as previously provided to the court, the Defendant has been recklessly discharging their firearm in public spaces throughout the pursuit. In the case of #22-CM-0014, State of San Andreas v. Naomi Mizuno, the Superior Court of the State of San Andreas has ruled that for the charge VF04 - Felony Public Endangerment to be applicable the Defendant must place the public in acute danger. In the underlying situation, the Defendant had evidently been discharging their weapon recklessly throughout the pursuit into well known crowded places. As such, the Prosecution can only conclude that this action should result in the application of the charge VF04 - Felony Public Endangerment.

Further, the Prosecution notes that as per the evidence as previously provided to the court, it becomes evident that once the pursuit had ended, the Defendant exited their vehicle together with the other individuals, took out their firearms and began discharging these towards the Officers on the scene. At the very least, as per the witness statements provided backed up by the bodycam footage, the Defendant and his companions fired at Officers Black and Hartwell. Following this, the Prosecution can only conclude that these actions should result in the application of the charges SF02 - Attempted Murder of a Government Employee, SF02 - Attempted Murder of a Government Employee and WM01 - Unlawful Brandishing of a Firearm or Weapon.

Finally, the Prosecution notes that, it is clear beyond any reasonable doubt that the Defendant and the other individuals that were being pursued are affiliated with each other in a criminal way. Per the ruling in the case of State of San Andreas v. Nanna Bohanna, it is case law that the charge NM03 - Unlawful Assembly should be explained that it is only applicable in cases where a Defendant is gathering together with another individual or other individuals to do something illegal. The Prosecution notes that this something illegal in this case is the obvious collaboration in the attempt to commit a murder, evade officers while shooting at them, etcetera. As such, the Prosecution can only conclude that the action of this intentional collaboration should only result in the application of the charge NM03 - Unlawful Assembly.

Sincerely,

Motion for Involuntary Dismissal
San Andreas Judicial Branch
Motion for Involuntary Dismissal

Honorable Daniels,

  • We the Prosecution in the case below are requesting an involuntary dismissal from the court, please find the reason for it below.
State of San Andreas v. Zeak Crus
    Assigned Court Case Number: #22-CM-0069
    Requesting Party: Prosecution
    Party Members: Roderick Marchisio
Involuntary Dismissal: Unreasonable Delay, Failure to Make Contact with the Court
    Detailed explanation:
The Prosecution notes that the Defense has not reacted on anything submitted by the Prosecution as per the 14th of October. As such, it has now been 42 days since the Defense has let the court or Prosecution know anything. We argue this has placed undue burden on the State and delayed this case to an unreasonable degree. Further, the Prosecution notes that the Defendant has not been seen by anyone in the State since the 8th of October and as such seemingly has left the state.

As such, we would like to ask the court to dismiss the case on involuntary grounds and with this, include the Motion to Amend Charges in the final verdict. The Prosecution notes that as the Motion to Amend Charges had been filed before the announced changes to the docket, the principles of legal certainty and due process dictate this Motion should not be changed retroactively and would like to kindly request you to confirm this in your decision on the Motions as previously filed by the Defense.

    Thank you for your consideration.

Sincerely,

Deputy Attorney General

  • Honorable Daniels,

The fact that almost a week has passed since the Motion for Involuntary Dismissal says plenty about both the Unreasonable Delay as well as the Failure to Make Contact with the Court. As such, the Prosecution would like to ask for a conclusion on the Motion for Involuntary Dismissal.

Respectfully,

Superior Court of San Andreas
"EQUAL JUSTICE UNDER LAW"

COURT DECISION

IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Zeak Cruz
#22-CM-0069

A decision was reached in the above case on the 6th day of December, 2022.

I will be granting the Motion for Involuntary Dismissal posted by the prosecution. The defendant and defense council have failed to make contact with the court for over 50 days now delaying this case to an unreasonable degree. However I will not be making a decision on the Motion to Amend Charges as I am dismissing this case.

This case is now closed.
