- The Defense is requesting that the decision on the Motion to Compel Discovery for the full warrant request and signed warrant be overturned.
On the hearing that took place on the 8th of August, 2022. The following decision was made:
In regards to Exhibit #12, I will be striking this exhibit from the record as well as denying the motion to compel discovery asking for the search warrant request as it is not relevant to the charges the Defendant is contesting at this time. The court believes that is a different matter, that holds no ground in regards to what charges are being contested at this time.
The Defense contests this decision, the search warrant and more importantly the justification and evidence behind it is directly relevant to proving the Los Santos Sheriff's Department had not established proper reasonable suspicion and/or probable cause in the initial traffic stop.
