A Major Change for Drug Charges

    For some time now, it has been evident that the language in San Andreas Penal Code of the Drug Charges, both misdemeanors and felonies, have needed an update. For the past couple of weeks, the San Andreas Judicial Branch has sought opinions from other government agencies within the state regarding what these sections lack and how they could be improved. The San Andreas Judicial Branch, in conjunction with the San Andreas State Government, is pleased to present the amendments for both the Drug Misdemeanor (DM) and Drug Felony (DF) categories.

    To begin, the former charge of DM01 - Controlled Substance Possession has been divided into three different charges. This division split controlled substances into schedules, which are categorized by their potential for abuse and their medical usage, or lack thereof. In the State of San Andreas, there has never been a public document outlining specifically what is to be considered a controlled substance. Finally, with the release of the these three Controlled Substance Possession charges, they have been listed and defined.

    Second, we are proud to announce the decriminalization for small amounts (personal use) of Cannabis, more commonly referred to as marijuana. For individuals in simple possession of, up to and including, 0.25 oz (7 g) of processed marijuana, 10 marijuana plants, and any amount of marijuana seeds, you are only to be cited for GC06 - Possession of Cannabis. Individuals who exceed any of the limits listed above are liable for prosecution under DM03 - Possession of a Schedule III Controlled Substance.

    Furthermore, in almost all drug charges you will notice one similarity: the note of either medical prescriptions and medical licenses, or with the appropriate licensing. These will allow for medical prescriptions given by the Los Santos Emergency Medical Services some time in the future. As of the time of this release, the LSEMS will only be giving out prescriptions for Methadone, a substance used to curb the side effects of withdrawal from addictive substance usage in order to assist those trying to become sober.

    Another major change we would like to announce is the new charge DM06 - Cultivation of a Controlled Substance. This charge will be for individuals that are cultivating a controlled substance, which is defined as the gathering, growing, production, or possession of plants and/or other naturally occurring elements with the purpose of being used in the creation of controlled substances.

    Finally, we have raised the listed amounts for felony possession charges, changing DF01 - Possession of a Controlled Substance with Intent of Sales to: "Possessing any controlled substance with an amount greater than 1 oz (28 g), or equal to 1 oz (28 g) or less in a way that would indicate use for sale and delivery, without the appropriate licensing." and similarly increasing the listed amount for DF04 - Trafficking a Controlled Substance, which now reads: "Possessing any controlled substance of an amount greater than 3 oz (84 g) without the appropriate licensing."

    To conclude, we are confident these amendments will only help the community and assist with lowering the incarceration rate for non-violent offenders. Please be aware that not all changes and additions were touched upon in this announcement - a full list of changes can be viewed on the STATE OF SAN ANDREAS PENAL CODE in addition to the recent Amendment to Drug Charges Notice. If you would like clarification on any language that have been included in this update, please reach out to the San Andreas Judicial Branch, as we want to ensure that the interpretation of these changes is standard across the board.
