  • Counselors,

The Motion for Discovery posted by Prosecutor McNamara has been automatically denied and removed from the docket due to Exhibit #2 being under seal. Search Warrant Applications are by default sealed information and can only be unsealed after a formal request to the judge that signed the warrant. However the Search Warrant Approval is not sealed and can be made public through a Motion for Discovery.

    Respectfully,

Motion for Involuntary Dismissal
San Andreas Judicial Branch
Motion for Involuntary Dismissal

Honorable Colt Daniels,

  • We the Defense in the case below are requesting an involuntary dismissal from the court, please find the reason for it below.
State of San Andreas v. Abdi Jet
    Assigned Court Case Number: #22-CM-0059
    Requesting Party: Defense
Party Members: Sarah Williams, Robert Winejudge
Involuntary Dismissal: Failure to Comply to Court Order, Unreasonable Delay
    Detailed explanation:
On the first (1st) of October 2022, the Honorable Colt Daniels filed the order for discovery on the public docket. On the fifth (5th) of October 2022, the Honorable Colt Daniels denied a submitted motion as it contained an exhibit under seal. On the seventh (7th) of October 2022, prosecutor McNamara resigned from service (see: viewtopic.php?t=117701), and as of yet, the State has not found new representation. As the docket currently stands, nine (9) days have passed since the Order for Discovery was originally submitted and no evidence stands on the public docket. The burden of proof in this criminal case, as in all criminal cases, lies with the prosecution, who is obligated to present all of the evidence available to them within seven days of the Order of Discovery. The motion for involuntary dismissal should be granted as the State has failed to fulfill its burden of proof, nor has the State filed a Motion for Continuance, ignoring the court Order of Discovery.

    Thank you for your consideration.

Sincerely,
