Narrative:
I was near some kind of docks and I was asked to leave by a cop. I searched for the exit as I was lost, I found the exit and went to leave. The only exit was blocked my a cop. I was then tased and arrested for not leaving the area, after I was searched and a weapon was found.

          • Person was attempting to pick up a person we chased on foot, after hearing him on the phone to get somewhere i turn my sirens on to where he U turns going to the end of the docks, somewhat towards his fried, failing to comply to leave when i said. Futher onwards someone searched him and found a firearm on him, unlicensed. At DOC failed to comply many times making me ask him 5+ times just for one thing.

    Detailed explanation:
    There was no reasonable suspicion to search my client as they stated that they were lost and the only exit out of the docks was blocked by a police officer. Now my client being given a request that they could not reasonably fulfill should not constitute a reason to search and detain. However, regardless of this, a failure to comply should only result in a citation in addition to a request for Identification. None of the testimonies refer to requesting and failing to receive identification so detainment, search and arrest were completely unwarranted.

    As discussed during the Motions Hearing held on 14/SEP/2022, the Motion for Discovery submitted by the prosecution will be admitted into evidence in part, while the Motion for Suppression is denied.

    The first two exhibits within the prosecution's Motion for Discovery were granted, however, the witness statement provided by Deputy Chief Sanchez will not be admitted into evidence. The court thanks the Deputy Chief for providing a response to the prosecutor in this case, however, the statements included do not have any tendency to make a fact that is important to the case more or less probable than the fact would be without the evidence.

    Regarding the Motion to Suppress, the court has made the decision to deny this motion as the intent of the motion gets at the heart of what this case is about - whether or not Mr. Watson was given a lawful order, and further, if Mr. Watson complied with this order or not.

    If it is found that Mr. Watson did indeed violate the GM10 - Failure to Comply / Identify charge, he would have been subject to search and seizure incident to arrest, however, if it is found that Mr. Watson did not violate the GM10 charge, he likely would not have been subject to search and seizure, therefore, calling the admissibility of property seized during the arrest in question.

    The argument against the Failure to Comply / Identify charge is better saved for trial, so the verdict of that charge will be held until the conclusion of the trial.

    Within the next 48 hours, I will be providing a scheduling tool for parties to mark their upcoming availability to schedule the trial for this case.

IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Ryan Watson
22-CM-0053

CHARGES BEING DISPUTED:
GM10 - Failure to Comply/Identify
WM02- Possession of an Unlicensed Firearm

A verdict was entered in the above case on the 26th day of October, 2022.


  • The case of #22-CM-0053, State of San Andreas v. Ryan Watson has been resolved.

    In the State of San Andreas Penal Code, Failure to Comply / Identify is defined as "Failure to comply with a lawful command by a law enforcement officer, including when he requests you to identify who you are during the course of an investigation." In this case, the court has established that a lawful command to leave the area had been given by officers involved, however, the court must further determine that this lawful command was not complied with in order to convict the defendant of Failure to Comply.

    The defense has introduced doubt as to the defendant's intent, citing that the defendant was attempting to comply with the lawful order but was lost and unsure of the way out, as reflected in his witness statement. The prosecution claims the contrary, asserting that the defendant was not lost, but rather, was communicating with a suspect of an evasion from law enforcement, in an attempt to assist with that evasion.

    When examining the evidence to support this claim, the arrest report states that the method of communication was reported to be via phone, however, in the witness statement provided by the same officer, the method of communication was via radio. Additionally, the only connection offered in evidence between Mr. Watson and the evading suspect is a single reference to the evading suspect being a friend.

    Finally, regarding intent, we have only a statement that Mr. Watson had made at least one U-turn, somewhat towards the other individual, with a claim that he had "intentions of picking the person up," however, this evidence is vague and does not make it clear as to what actions Mr. Watson took that would show his potential intent.

    I have found the doubt introduced by the defense to be reasonable that the defendant was perhaps unsure of how to properly exit the area, and the claim that Mr. Watson was conspiring to pick up the other individual has not been supported by substantial enough evidence to convict him of the Failure to Comply charge. As for the Possession charge, the fruit of the poisonous tree doctrine will be used to reject the evidence seized as a result of the arrest.

    It is with the above considerations that I issue the following verdict:
    • On the count of GM10 - Failure to Comply/Identify, I find the defendant, Ryan Watson, not guilty.
    • On the count of WM02- Possession of an Unlicensed Firearm, I find the defendant, Ryan Watson, not guilty.
