Defendant Name: Martin James
Defendant Phone: 2286946
Defendant Address: Undisclosed
(( Defendant Discord: Pegasus_#4123))
Requested Attorney: Tony McFornell
Image
Charging Department: LSPD
Image
Time & Date of Incident(s): 10/JUL/2022
Charge(s):
Evading an Officer, Possession of Illegal Firearms, Tampering with Evidence, Armed Robbery, Possession of a Controlled Substance while Armed
Narrative:
I was driving my motorcycle going towards the city, when some cop on a bike tells me to pull over and ID. I comply, next thing I know is I'm getting jumped by three different units. I drove off cause I know I'd get busted for the gun on me, on top of a pack of money I had been unable to unload earlier in the day. When they found the pack they decided I had gotten it through armed robbery. And yes, while I carried a firearm illegally, I hadn't been part of any robbery or been complicit to anything like it, ending up with me receiving unfounded charges. I was also charged with controlled substance possession while armed, even though I didn't have no drugs on me. I filed a complaint against the charging officer to LSPD IAG, but they decided it was not worth their time to investigate one of their officers fabricating charges with no evidence to back it.

I, [Martin James], hereby affirm that all information provided above is true and correct to the best of my knowledge, and understand that knowingly providing false information could result in additional charges and/or fines. (( I affirm that all information submitted has been obtained via In-Character means. ))

  • Parties,

As discussed in today's hearing, both Motions for Discovery were granted and the Motion to Compel Discovery was responded to with the dropping of the DM04 - Possession of a Controlled Substance while Armed charge.

Additionally, the defense requested the opportunity to question Officer Luca Andollini and Detective Olatunji Osas through witness examination at trial or through the deposition process.

Until a formal deposition process is established, this case is now pending preparations for trial.

Motion to Compel Discovery

Honorable Judith Mason,

  • We the Defense in the case below are requesting the disclosure of the following material by opposing counsel, please find a detailed reason as to our request below.
State of San Andreas v. Martin James
    Assigned Court Case Number: #22-CM-0043
    Requesting Party: Cyrus Raven
Party Members: Cyrus Raven (Attorney), Martin James (Defendant)
Discovery from: Witness - Luca Andollini

    Type of Discovery: Deposition
    • The Defense is requesting a time to depose Officer Luca Andollini
    Detailed reasoning:
    • Officer Andollini provided body-cam footage in this case. The Defense wants to question him about what happened and what he saw.

Discovery from: Witness - Olatunji Osas

    Type of Discovery: Deposition
    • The Defense is requesting a time to depose Detective Olatunji Osas
    Detailed reasoning:
    • Detective Olatunji Osas provided body-cam footage in this case and was directly involved in the arrest of the defendant. The Defense wants to question him about the events in question.
The Defense is flexible in this matter, while we would prefer a chance at an oral deposition or even examination/cross-examination, we will accept whatever the court finds suitable depending on the availability of the witnesses and prosecutor.

  • Honorable Mason,

A deposition may be taken only in exceptional circumstances when it is in the interest of justice that the testimony of a prospective witness of a party be taken and preserved. The Prosecution notes that as there is a complete incident overview of bodycam footage available, the Motion to Compel Discovery is absolutely disproportional given the facts and circumstances of the underlying case.

  • Parties,

While I can understand the defense's intention to get more information and clarity regarding this case, the Judicial Branch does not currently require officers to take part in the deposition process, and thus, I will not be requiring that the requested officers sit for depositions.

While the information that could have been provided in the depositions may end up proving useful by the prosecution to dispel reasonable doubt, it is ultimately up to both parties to choose to undertake the process of a deposition. Similarly, I am currently unable to compel individuals to be present for witness examination on the stand at trial.

Therefore, unless there are further motions to be considered, this case is now pending trial. Please use this scheduling tool to mark your upcoming availability.

CHARGES BEING DISPUTED:
VF01 - Evading an Officer
WF03 - Possession of Illegal Firearms
GF16 - Tampering with Evidence
GF03 - Armed Robbery
DM02 - Possession of a Controlled Substance while Armed

A verdict was entered in the above case on the 3rd day of November, 2022.

  • The case of #22-CM-0043, State of San Andreas v. Martin James has been resolved.

A plea agreement signed by all parties has been accepted by the court. As outlined in the full agreement, the prosecution agrees to no longer pursue the charges of GF03 - Armed Robbery and DM02 - Possession of a Controlled Substance while Armed in exchange for a guilty plea of VF01 - Evading an Officer, WF03 - Possession of Illegal Firearms, GF16 - Tampering with Evidence, and GF02 - Accessory to Robbery.

As such, the defendant will be compensated for time served and fines paid in relation to the amended charges.

It is with the above considerations that I issue the following verdict:
    • On the count of VF01 - Evading an Officer, I find the defendant, Martin James, guilty.
    • On the count of WF03 - Possession of Illegal Firearms, I find the defendant, Martin James, guilty.
    • On the count of GF16 - Tampering with Evidence, I find the defendant, Martin James, guilty.
    • On the count of GF02 - Accessory to Robbery, I find the defendant, Martin James, guilty.
