INDICTMENT


  • THE PROSECUTION CHARGES THAT:
    1. On 10/MAY/2022, a member of the Sheriff's Department was murdered after responding to a panic alarm from the convenience store near Bayview. The suspects fled in a pink I-Wagen and Hakuchou Drag, and all three were armed with .50 pistols. This was confirmed through analysis of bullet casings, determining three different firearms were involved. Investigators noted the Ali Valentine, Nicholas Valentine, and Jason Valentine had been previously arrested for possession of firearms. Investigators conducted ballistic analysis of the firearms in evidence, and noted one of the firearms was a match to the firearm used to murder the Sheriff's Deputy. The specific firearm was recovered from Nicholas Valentine on 26/May/2022, two weeks after the murder of the Deputy, and the firearm was confirmed to be illegal.

      The suspicions are confirmed by off-duty Deputy Jeremy Williams who spoke with Nicholas Valentine in the parking lot of Bayview immediately prior to the store robbery and murder of the Deputy, and witnessed Nicholas and the Valentine brothers go into the store immediately prior to the events unfolding.

      As such, it is the position of the State of San Andreas that Nicholas, Ali, and Jason Valentine took property from another person without uncoerced consent through the use of a firearm (GF03), engaged in the non-premeditated killing of a government official (SF02), possessed any type of firearm, weapon, parts of a firearm/weapon, ammunition or a firearm without a serial number (WF03), and while operating a standard road vehicle, off-road vehicle, or bicycle, willfully flees or otherwise attempts to elude a pursuing law enforcement officer (VF01)

      All occupants of a vehicle are liable to be charged with VF01 if they willfully partake in the act."

      Taking the property of another person off of them without uncoerced consent through use of a firearm or deadly weapon.

  • Due to Jason Valentine failing to make contact with the court after multiple months it has been decided that this case will be split into "State of San Andreas v. Nicholas & Ali Valentine" and "State of San Andreas v. Jason Valentine" at this time the court will be severing the defendant Jason Valentine from #22-CM-0026 and issuing a warrant for his arrest under a new docket number.

    At this time the court moves to seek council on behalf of the state and the defendants (Nicholas Valentine & Ali Valentine) in this case should they seek public defense.

      Crime Scene Summary:
      At approximetly 23:30 UTC on 10/05/2022 there was a distress call from the store at Bayview. The first unit to respond was ambushed and called Code 1 ((Martin Haswell)). Other units including myself were already on route. As we arrived the unit was laying face down on the ground, I checked their pulse, and they were deceased. Around the body were multiple bullet holes and bullet piles, all from Pistol .50s, except the SMG rounds that were fired from the deceased unit. The bodycam was still working and was taken and footage replayed to see what happened.

      The footage showed three men exiting the store and drawing firearms. Each suspect was armed with a Pistol .50, a Pink skull mask, white shirt and pink pants. The footage also showed a Lilac coloured Hakuchou Drag-. The footage also showed that the deceased Sergeant only fired their SMG and that he was fired upon first. The Sergeant began firing at the I-Wagen before being shot from behind by the Hakuchou Drag, which then executed him.

      Also, at Bayview was Jeremy Williams, who was off duty and working at Bayview. Deputy Williams witnessed the whole situation and told us that he believed it to be the “Valentines” family, specifically Ali Valentine and Nicholas Valentine. He also mentioned a pink I-Wagen. Soon another call came in of another store being robbed, this time Meow-Meow on Senora Freeway. Units were able to get there in time to pursue the I-Wagen registered to Ali Valentine. The vehicle had tires already shot out from the previous scene at Bayview. The car was abandoned after spinning out, and the suspects got into a black Kamacho I believe. I'm not sure if they fired upon the pursuing units while in pursuit, but it is likely.

      Inside the vehicle was packed cash. I was able to collect prints on the cash, the prints belonged to Jason Valentine. Investigator Wilkinson collected as many of the bullets as he could from the Bayview scene and compared the .50 rounds.

      Forensics Investigation:
      Inside the vehicle was packed cash. I was able to collect prints on the cash, the prints belonged to Jason Valentine. Investigator Wilkinson collected as many of the bullets as he could from the Bayview scene and compared the .50 rounds. From this he was able to determine that three Pistol .50s were fired, as two of the bullets matched each other and the other two did not match with any. This proves that three separate .50s were fired.

      I went to the store at Bayview to review the footage and was able to get a still of the three men robbing the store. I saved the footage to a SD card but was unable to review that footage, nor was Investigator Wilkinson due to the SD card seemingly being corrupt. ((The error when reviewing footage kept happening.))

      Incident Summary:
      We had noticed that there had been multiple arrests made against Nicholas Valentine and Ali Valentine respectively in which they were arrested for possession of .50 handguns.
      Most of these arrests were made by the LSPD, therefore we got in contact with them and asked them for the evidence pertaining to these arrests, which we were quickly helped out with by Detective David Wallace, who gave us access to the firearms and the Mission Row Shooting Range, where the ballistic testing for the involved firearms took place in this instance.
      Overall, four firearms were fired.


      Firearm #5 in this case is a bit of an anomaly, it was tested because it was in possession of Lina Valentine as she had been arrested whilst being with Ali Valentine, our actual suspect in this case.

      Bullets from all of the above firearms were tested and cross-checked with all bullets collecting from the scene on the night of the murder.

      Results, overall, returned negative, except for Firearm #7, which was proven to be the very same firearm used in the night of the murder, as the unique rifling pattern and engraving on the bullet fired from the firearm as part of the ballistic testing process is identical to the one found on the night of the murder, specifically, it matches Firearm #5 mentioned in the report made on the night of the murder.

      Therefore, we can reasonably conclude and say that Firearm #7 and Firearm #2 are the same firearm and thus, one of the three murder weapons used.


      Nicholas Valentine is the individual that was previously reported by a Jeremy Williams to have been seen on the night of the murder, at the location.
      As Jeremy Williams is a sworn-in employee of the Los Santos County Sheriff's Department, his witness report should be strongly taken into account in this case.

      There are multiple next steps that could be taken in the course of the ongoing investigation.
      Personally, I would like to bring this forward to a prosecutor now and have them go through the judicial system with us, as we have a very strong case in our hands, but not enough to be 100% certain.

      Alternatively, Mr. Nicholas Valentine could be brought in for questioning in regards to this matter and possibly charged there and then, however this could jeopardize the course of the investigation. This report has proven that the suspects in question have likely not disposed of their firearms after the killing this casefile aims to investigate. Therefore, it is not unlikely that the order firearms that are still missing from the equation might still pop up and be further identified and tied to the killing.

        Dear Mr Modi,


        Unfortunately, I don't remember exactly what happened that night, but I will provide all of the details that i can remember.

        It was a quiet night at Bayview when an old co-worker, Ali Valentine came in to get his vehicle repaired with his family. I believe that the vehicle was a scout, or maybe an I-Wagen, an SUV-looking vehicle I remember. I know it was Ali due to a nickname he has for me, and I saw Nicholas without his mask on for a moment, I believe he was eating or drinking. It was a fairly normal night, I repaired his vehicle and had a small chat about how he was doing, etc. After the repair, they got in their vehicle and went to the Bayview store to what I thought was to shop for some food or water. After a few minutes, I saw my Sergent pull into the Bayview lot as lots of deputies do when I saw him get out of his vehicle. It was then I saw people start running out of the Bayview store pulling out guns and shooting. It was then that I went inside the building and hid in fear of getting shot. Once the shooting slowed and stopped, I ran outside to see lots of deputies arriving on the scene and seeing my Sergent on the floor.

A decision was reached in the above case on the 30th day of October, 2022.


It was determined at the hearing that several sentences in the statements given within the evidence provided by the prosecutions Motion for Discovery would be suppressed. Those statements are as follows;

  • Exhibit 1: Los Santos Sheriff's Department Investigative Case File
    "The car was abandoned after spinning out, and the suspects got into a black Kamacho I believe. I'm not sure if they fired upon the pursuing units while in pursuit, but it is likely."
    This statement has been suppressed due to speculation.

    This statement has been suppressed due to hearsay.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Nicholas & Ali Valentine
#22-CM-0026

A decision was reached in the above case on the 19th day of December, 2022.


The evidence in this case shows that Nicholas and Ali Valentine entered the store on the day in question, proceeded to rob the store owner at gunpoint taking the cash from the stores register and flee the store where they engaged in a gun fight with the Sergeant from the Los Santos County Sheriff's Department who died from his injuries. Later the suspects then fled from law enforcement after again another store robbery.

The prosecution was able to provide enough proof to meet the burden they had on this case with regards to the charges of Armed Robbery, Possession of Illegal Firearms/Weapons, and Evading an Officer. However, due to the body camera footage provided, the court was unable to determine who and how many of the individuals who robbed the store actually shot and killed the Sergeant. Therefore there was reasonable doubt in regards to the charge of Murder of a Gov. Employee.

It is with the above considerations that I issue the following verdict:
  • On the count of SF02 - Murder of a Gov. Employee, I find the defendant, Nicholas Valentine, not guilty.
  • On the count of GF03 - Armed Robbery, I find the defendant, Nicholas Valentine, guilty.
  • On the count of WF03 - Possession of an Illegal Firearms/Weapons, I find the defendant, Nicholas Valentine, guilty.
  • On the count of VF01 - Evading an Officer, I find the defendant, Nicholas Valentine, guilty.

  • On the count of SF02 - Murder of a Gov. Employee, I find the defendant, Ali Valentine, not guilty.
  • On the count of GF03 - Armed Robbery, I find the defendant, Ali Valentine, guilty.
  • On the count of WF03 - Possession of an Illegal Firearms/Weapons, I find the defendant, Ali Valentine, guilty.
  • On the count of VF01 - Evading an Officer, I find the defendant, Ali Valentine, guilty.
