- In all honesty, I do not fully recall this situation, but I don't doubt I was involved in some way with having presence on the scene. Regarding the brandishing a firearm charge, as noted in the arrest report, the firearm(s) that Mr. King were in possession of were inspected to see if they were fired recently. DeAndre was on the scene of a shootout and in possession of multiple firearms, which he admits to having due to his statement of no contest to the possession charge. Upon inspection of the firearm(s) it was determined one or both were fired recently due to either the smell of freshly ignited gunpowder and/or a warm gun barrel. Any reasonable person can deduce that a firearm would not be fired while holstered or in someone's waistline where the firearms were found or we would have found injuries on DeAndre indicating as such. If they were not fired while "holstered", the firearm must have been fired off while "un-holstered" or brandished in some direction. While we were unable to prove which direction he may have fired in to place any charges for assault w/ a deadly weapon or (attempted) murder, it can be determined that he fired the weapon(s) which means he must have brandished them. Since the firearms were not legal, it would not have been legal to brandish them to fire them in the area he did.
This is all I can recall to the best of my knowledge regarding the situation.

- On June 24, 2022, officers responded to a disturbance call in the alleys behind a small carwash near the Motorsnacks convenience store. Upon arrival, officers located many vehicles, bullets, bodies, and injured suspects. One of the injured suspects was Deandre King. Under reasonable suspicion granted from the firefight and possible involvement, the suspects were patted down after being treated. Deandre was found to be in possession of an illegal firearm with a suppressor. Considering the situation, Sergeant Breacher felt the barrel of the firearm and it was warm indicating it was recently fired. According to official statistics, a firearm's barrel should only remain warm for around 10 minutes after it was fired. Considering the scene, where he was injured and others in a shootout, and that he is in city limits with no legal place to discharge his firearm close by, he must have had an involvement in the scene. He was charged with unlawful brandishing due to this as his weapon should not have been drawn to fire. The definition of WM01 is "Drawing, exhibiting, brandishing or using a firearm or weapon without a lawful reason." in this instance using the firearm unlawfully.

- On the 24th of June, 2022 a 911 call was made about an incident happening around the Carwash in Strawberry. Upon arriving on scene, we noticed multiple injured individuals, abandoned cars and deceased invidivuals. Officers began to secure the scene, making sure that nobody was able to get in or leave while other Officers began to secure and treat the injured individuals weapons and wounds. One of the injured, DeAndre King, was cuffed, searched and read his rights before having his wounds treated by myself. It was apparent that Mr. King was involved in the shootout that happened, including firing the weapon that was found on his person at the time. Sergeant Breacher was in possession of the firearm that was directly taken off of Mr. King and felt the barell, of which was warm at the time indictation that it has been shot recently. Sergeant Breacher made the call to charge Mr. King with WM01 - Unlawful Brandishing of a Firearm or Weapon.
Mr. King was then treated at Pillbox Hill Medical Center before being transported to DOC to serve his time.

IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. DeAndre King
22-CM-0032
CHARGES BEING DISPUTED:
WM01 - Unlawful Brandishing of a Firearm or Weapon
A verdict was entered in the above case on the 22nd day of October, 2022.
- At trial it was determined that at least one firearm was recovered off of the defendant following a gang shootout that left him injured. The firearm recovered was discovered to be warm to the touch by a Sergeant of the Los Santos Police Department and that fact was affirmed through multiple witness statements and arrest report.
A firearm being warm to the touch indicates that the firearm was recently discharged and due to the injuries sustained by the defendant, it was determined that the firearm was not holstered or in his waistline at the time in which it was discharged. This evidence in conjunction with the location in which the shootout took place leads the court to the conclusion that the defendant publicly displayed the firearm in a manner in which is unlawful.
It is with the above considerations that I issue the following verdict:
- On the count of WM01 - Unlawful Brandishing of a Firearm or Weapon, I find the defendant, DeAndre King, guilty.
