#22-CM-0023, State of San Andreas v. DeAndre King

by DeAndre Stacks
Defendant Name: DeAndre King
Defendant Phone: 3545400
Defendant Address: Arcadius Appartments
(( Defendant Discord: realAlex#0001 ))
Requested Attorney: Self-Representation
Charging Department: Sheriffs Department
Time & Date of Incident(s): 12/05/2022 1745
Charge(s): Reckless Operation (original reason for arrest). Possession charges for what was found on my bike and person.
Narrative: I do not dispute the fact that I was speeding, but I do dispute the fact that my driving was at any point reckless. I was keeping to the road surface at all times, did not ever get any air time and my speed was not that fast. I even stopped and paid for the toll booth, that is not the behavior of a reckless driver.
I asked the Deputy how does he justify the arrest, and he said that he clocked me going 196. Another deputy chimed in and said that if I go 80 or over the speed limit, it's reckless operation. I do not disagree with that in theory, however, in practice, I was going exactly 51 over the speed limit (this happened on a highway). This fits very comfortably into the Speeding 3rd degree charge.
The deputy then didn't even press the charge of reckless operation, but this was the charge that he used to justify the detainment, and instead placed other charges, however, I argue that if he had not tried to arrest me for a false charge, the other crimes wouldn't of happened/would not have been discovered. The subsequent search, and arrests are fruits of a poisonous tree and therefore, in my opinion, all invalid.
I, [DeAndre King], hereby affirm that all information provided above is true and correct to the best of my knowledge, and understand that knowingly providing false information could result in additional charges and/or fines. (( I affirm that all information submitted has been obtained via In-Character means. ))

- Deandre King was going 196KMPH southbound of Braddocks Tunnel, he was going at extremely high speeds. He was on a motorcycle, and he was in the middle of the path where the median strip separates the lanes. He pulled over and I was going to arrest him for reckless operation, the main reason for driving on the median strip, and failing to maintain the lane, in addition to this it was due to him going 61 over the speed limit ( 196KMPh ). When I asked him to step off the bike, he drove off, as he attempted to drive off, Dante Archer tazed him off the Drag, and he was in Brayton's Custody. I quickly removed all our vehicles from the highway, ensuring the highway is safe to be driven on. (( I was also going to write on the details that his headlights were off, but I was not 100% sure. I rply have body cam, however, I didn't actually get to save the footage, and neither did Deandre King ))

Witness Statement
- [In all honesty, I barely remember this situation. The only thing I can go off is the arrest report which I've stated that he was driving 51 over the speed limit, as well as driving on the median strip on the highway which I class as failure to maintain lane. Now along with the high speeds mixed with going in and out of another lane, I'd personally class that as reckless driving. ]

Witness Statement
- Good day,
Thank you for reaching out to me regarding this case file, I will happily provide the requested information.
Late night on May 12, I was patrolling the county and was available to respond to both 911 calls and backup requests. Deputy Kian Lawless with the badge number 19505 radioed a traffic stop on a Drag whose registered owner was Deandre King and requested additional units on his backup since he was going to arrest the driver. I was nearby and responded to his backup call, upon arrival I stepped out of my cruiser and stood next to deputy Lawless to see what was going on. Mr. King and deputy Lawless argued that he wasn't going recklessly and shouldn't be arrested, I tried to deescalate the situation but I also sensed that he may take off and try to evade us so I deployed my taser, and once he noticed that I have my taser ready he turned on the bike's engine and tried to escape but he was off the bike (tazed) and his evasion attempt was unsuccessful. Once he was off the bike and apprehended by deputies, we found a firearm with attachments and narcotics in the bike's glovebox. I would also like to mention the fact that he tried to evade rather than let me investigate the situation by checking the deputy's dashcam/bodycam to ensure he wasn't making a false arrest.
If you have any other questions, please don't hesitate to reach out.
Regards.

Witness Statement
- [Due to how far back the arrest was, I can remember very vaguely as to what happened. I responded to a backup request for a traffic stop conducted on Mr. King. The reason for the traffic stop, as stated on the arrest report, was that Mr. King was caught driving at 196KMPh. I sat as a pursuit unit per SD protocol and allowed for the traffic stop to be concluded. Only when Mr. King decided to accelerate and was subsequently tazed off his bike did I exit the vehicle. I can't recall any involvement I had if any in the arrest of Mr. King due to the time between the arrest and movement forward of the case. ]
