In accordance with the availability reported by both parties in response to the Notice of Scheduling, this trial shall take place at 07:00 PM on 24th of May, 2025 at Rockford Hills City Hall, Carcer Way, Metro Los Santos, SA.

NOTICE OF SCHEDULING

An attempt to schedule was made and recorded by the court on 30th of May, 2025.


((Sorry guys I was super sick with the stomach bug!)) I apologize for the previous cancellation. Please see the new scheduling below.

All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case. When the scheduling tool has been completed by either party, please post on the docket stating as such.

In the event all parties have overlapping availability the Presiding Judge will determine the best date and time to have a trial take place and post a Notice of Trial informing all of the upcoming proceeding.

In the event some or all parties do not have overlapping availability, the Presiding Judge will continue to attempt to schedule the proceeding or seek alternative avenues to conclude the case.

If either party has the intentions of calling a witness to the stand during the proceeding they must inform the court by filing a Witness List at the time of filing their availability. If no Witness List is filed before the Notice of Trial is filed you will be unable to call a witness during the proceeding.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Huw Masons
#24-CM-0093

A decision was reached in the above case on the 13th day of June, 2025.


The court appreciates the work of both parties during the trial. The uncontested facts of the case are the defendant putting on a mask, taking out his department issued taser, and tasing a man, later identified as Lee Ping. The contested facts on both sides lie in the actions of the alleged victim Lee Ping. Prosecution contests Lee Ping was requesting application information for the San Andreas State Government. The defense contests Lee Ping was displaying nuisance-style behaviors/assaulted another individual.

The court finds there to be enough reasonable suspicion established to allow for the detainment of Lee Ping. However we do not find there to be sufficient evidence to prove he was a current threat to individuals on scene at the time of the tasing. Lee Ping was seen on CCTV attempting to phone law enforcement at the time of the tasing, not advancing or threatening others.

When Commander Jessica Nash arrived on scene, she attempted to question the defendant about the situation and used her discretion to allow the San Andreas State Government to perform their own investigation into their employees conduct. The defendant initially attempted to mislead the officer by stating he did not know who had tased the individual, additionally the multiple reported issues by the Commander throughout different statements of mention of lies and misdirects, and finally the application of the mask prior to executing the reported assault. It is at this point that the court finds it prudent to indicate that all defendants have a right to remain silent. This right does not also protect individuals from providing false or misleading statements during an investigation.

Finally, the court will review the issue of the signing of a law and holding individuals to a law that has not yet been signed into law (GM25 - Possession/Unlawful use of Government Equipment). The courts will never retroactively apply charges to individuals. Individuals cannot be held accountable for actions they do not know are violations of either our penal code or Constitution.

It is with the above considerations that I issue the following verdict:
  • On the count of GM02 - Battery, I find the defendant, Huw Masons, wguilty.
  • On the count of GM14 - Obstruction of Justice, I find the defendant, Huw Masons, guilty.
  • On the count of GM02 - Battery, I find the defendant, Huw Masons, guilty.
  • On the count of GM25 - Possession/Unlawful use of Government Equipment, I find the defendant, Huw Masons, not guilty.
