An attempt to schedule was made and recorded by the court on the 20th of June, 2023.
All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case.
In the event all parties have overlapping availability the Presiding Judge will determine the best date and time to have a trial take place and post a Notice of Trial informing all of the upcoming proceeding.
In the event some or all parties do not have overlapping availability, the Presiding Judge will continue to attempt to schedule the proceeding or seek alternative avenues to conclude the case.
If either party has the intentions of calling a witness to the stand during the proceeding they must inform the court by filing a Witness List at the time of filing their availability. If no Witness List is filed before the Notice of Trial is filed you will be unable to call a witness during the proceeding.

A trial date was set on the above case on the 21st of June, 2023.
In accordance with the availability reported by both parties in response to the Notice of Scheduling, this trial shall take place at 7:00PM on the 24th of June, 2023 at Rockford Hills City Hall, Carcer Way, Metro Los Santos, SA.
Both parties are ordered to be present in the Judges Chambers no later than 15 minutes prior to the above listed date for pretrial arrangements. If complications occur that must result in a delay or cancelation of the trial, you are ordered to inform the court no later than 12 hours prior to the above listed date.

ISSUANCE OF VERDICT
IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 25th day of June, 2023.
In this case the prosecution has asserted that the defendant intentionally deceived the alleged victim, Travis Hawk in this case causing a loss of greater than $5,000. It is fact that three payments were made, one on the 13th of June, one on the 21st of June, and the final payment Apol Kolar received was made on the 27th of June. Between the 27th of June and the 11th of August no communication or payments have been made between Travis Hawk and Apol Kolar.
In the formal indictment, the prosecution asserts that the defendant changed the locks after the third payment but no date was given meaning it could have taken place anytime between the two dates. It is also fact that in the contract it states that if the alleged victim wills it, meaning that if he wished to withdraw the contract, he will be reimbursed minus 25%. The prosecution has failed to show any communication from Travis Hawk to Apol Kolar where he wished to withdraw from the contract and be reimbursed the amount paid.
It is the courts belief that the alleged victim defaulted on the contract and stopped paying the defendant. Following no communication or payment the defendant changed the lock as he was no longer allowing the alleged victim to rent the home as he has not made payment and after nearly one and a half months sold the property to a third party. During this there were no communication between the two parties.
It is with the above considerations that I issue the following verdict:
- On the count of GF07 - Felony Fraud, I find the defendant, Apol Kolar, not guilty.
