  • Exhibit #1: Arrest Report - Arthur Green, 06/MAR/2024
    Image
    Image

    Los Santos Police Department

    ARREST REPORT
    "TO PROTECT AND TO SERVE"

    MUGSHOT
    • SUSPECT DETAILS
      • Full Name: Arthur Green
        Phone Number: 4158372
        Licenses Suspended: No
        Officers Involved:
        • Police Captain III Jessica Nash
        • Deputy Chief Lex Roth
        Charges:
        • VF01 - Evading an Officer
        • GM04 - Resisting Arrest
        • GM19 - Face Concealment (b)
        • GM08 - Vandalism
        • GM05 - Receiving Stolen Property
        • GM06 - Petty Theft
      INCIDENT NARRATIVE
      • Incident Date: 06/MAR/2024

Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • I responded to a 911 call for a man smashing an ATM with a crowbar. When arriving on the scene I saw a man leaving on a BF400 and I turned around to pursue. The man evaded pursuit, heading up a mountain I couldn't drive up with my Buffalo cruiser. He was traced and found again in the city, wearing different clothes. He jumped off a ledge with his bike and stalled it. He tried running and punching me after being cuffed. I found the clothes on him he wore and compared it to bodycam footage of him, and it matched. He also had a crowbar and 2849 dollars of marked money on him. I was unable to suspend his license as he ran off inside DOC and hid before I could complete the process.
      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

Where possible, the serial number of each firearm seized as evidence should be noted.
        • Illegal Possessions:
Exhibit A: Marked Money (value $2849)
          Exhibit B: Clothing
          Exhibit C: Crowbar

          Legal Possessions:
          Exhibit A: Radio
          Exhibit B: GPS
          Exhibit C: Bag
          Exhibit D: Hat

    Case Information
    • Incident Date: 06/Mar/2024
    Witness Information
    • Name: James Boxer Date of Birth: 28/Oct/1987
      Phone Number: 500-8519
Occupation: Police Officer I, Los Santos Police Department
    Witness Statement
    • I responded to a 911 call from a civillian seeing a man smashing an ATM. When I arrived near the scene, I saw a man leaving the scene on a BF400. I chased him and he evaded pursuit. We found a man on the same motorcycle, but with a different outfit on, still evading pursuit.

When we arrested him, we found a crowbar, marked money (value $2849) and the clothes I saw on the man leaving the scene, on him. We held the clothes up to him to match the outfit to what was seen on the scene. The license plate matched the bike that fled the scene. His confirmed presence at the scene, the marked money and crowbar on him, as well as his repeated decisions to evade pursuit and resist arrest solidified that he was the man who smashed and robbed the ATM. I charged him with the below charges, as discussed with Chief Lex Roth.

      VF01 - Evading an Officer
      GM04 - Resisting Arrest
      GM19 - Face Concealment (b)
      GM08 - Vandalism
      GM05 - Receiving Stolen Property
      GM06 - Petty Theft

See below uploads of the 911 Call Record Log, along with footage of him fleeing the scene and then his arrest.

    • Prosecution and defense counsel,

Apologies to both parties as I only recently noticed the defense counsel on the case signed on as co-counsel and not primary. The court will be giving the defense 7 days time to find a suitable primary or the current co-counsel will be moved to primary.

The prosecution has posted their motion for discovery. Is the court to understand that the prosecution no longer requires time for discovery?

      MOTION TO AMEND

IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Arthur Green
      #24-CM-0067

A Motion to Amend was filed in the above case on the 2nd of October, 2024.

The State of San Andreas, by and through the undersigned attorney, filed this Motion to Amend, the original charges with the underlined amended charges.

      • Original Charges
        • GM08 - Vandalism
        • GM05 - Receiving Stolen Property
        • GM06 - Petty Theft

      • Amended Charges
        • GM08 - Vandalism
        • GM05 - Receiving Stolen Property

      • Detailed Explanation: The Lesser Offense doctrine would prevent us from charging both GM05 and GM06 as they both relate to the stolen money. The prosecution believes it would be better if we were able to focus on the GM05 as there is more evidence as the prosecution is unable to decisively say if the defendant took the money from the ATM, whereas we can prove he had marked cash on him.

          • Lack of Relevance:
I do not believe that it adds anything important to the case at hand. I also believe that this could be considered Prejudicial, I believe that it is trying to get the judge to have bias against my client by trying to suggest that he is a dishonest man.

            Speculation
This section has speculated that the man was specifically leaving the scene. This explanation of the incident is also contradictory to the witness testimony given by the same officer. In his Witness Statement, the officer claims that when he was "near" the scene, he saw the suspect leaving. Whereas in this evidence this evidence suggests that, upon arriving on the scene, he observed the suspect leaving. The bodycam footage referenced also shows how this piece of evidence slightly contradicts what occurred. This is significant as it implies that the officer observed the suspect at the scene of the crime, before the suspect had left.

          • Speculation
If the officer was only near the scene when he saw the suspect, is it right to assume that the suspect was coming from the ATM. Route 68, the road that the ATM is situated on, is a well used road, therefore I think that the suspect could have easily just been driving down Route 68 at an unfortunate time. I do not think it is fair to assume that the man was leaving the scene of a crime, when the officer was only "near" the scene of the crime itself.

In the final line of this statement it clearly reads, "I don't have anything to add that would aid this case". This witness statement does not, as it stated, add anything to the case at hand so I believe this Exhibit should be suppressed as it does not add anything.

        Docket Notice
"HERE FOR YOU | SAFE FOR YOU"

        • Honorable Judge Kant and pertaining parties,

The prosecution will be offering its rebuttal regarding the defense's motion to suppress.

Exhibit 1: The prosecution does not object to the suppression of the following line, which the defense argued should be suppressed on the grounds of relevance: "I was unable to suspend his license as he ran off inside DOC and hid before I could complete the process."

However, the prosecution does object to the suppression of the green-highlighted line on the grounds of alleged speculation. The officer's arrest report is based on observations made in real-time while responding to an active crime scene. The description of the suspect "leaving the scene" is corroborated by bodycam footage and the witness statement by Officer Boxer, both of which confirm the presence of the suspect in the surrounding area of the crime scene immediately after the ATM was vandalized. Furthermore, slight variances in wording between the arrest report and the witness statement ("near the scene" vs. "arriving on the scene") do not constitute material contradictions but are differences in how an officer might describe a fast-paced, unfolding event.

Exhibit 2: See the above rebuttal for Exhibit 1.

Exhibit 3: The prosecution will not be objecting to the suppression of this exhibit.

        COURT DECISION

IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Arthur Green
        #24-CM-0067

A decision was reached in the above case on the 10th day of October, 2024.

        Exhibit #1:
The court will start with a review of the speculation claims from the defense. To begin, speculation occurs when an individual testifies to information or observations that could not have been gained with any of their 5 senses: sight, haring, smell, taste, and touch. As the officer in question was testifying to what he saw, and that claim is backed up by bodycam footage of the BF400 leaving the area that a 9-1-1 call was reported. The court will be denying this suppression request in regards to speculation.

As for the statement quoted in reference to relevance, "I was unable to suspend his license as he ran off inside DOC and hid before I could complete the process." The court will be granting this suppression as both sides are in agreement.
        Exhibit #2:
The court will be denying this suppression in regards to relevance for the reason given above.
        Exhibit #3:
The court will grant a suppression of the entire exhibit. Due to both parties being in agreement.
