A decision was reached in the above case on the 10th day of October, 2024.
Exhibit #1:
The court will start with a review of the
speculation claims from the defense. To begin, speculation occurs when an individual testifies to information or observations that could not have been gained with any of their 5 senses: sight, haring, smell, taste, and touch. As the officer in question was testifying to what he saw, and that claim is backed up by bodycam footage of the BF400 leaving the area that a 9-1-1 call was reported. The court will be
denying this suppression request in regards to speculation.
As for the statement quoted in reference to
relevance, "
I was unable to suspend his license as he ran off inside DOC and hid before I could complete the process." The court will be
granting this suppression as both sides are in agreement.

The court will be
denying this suppression in regards to
relevance for the reason given above.
Exhibit #3:
The court will
grant a suppression of the
entire exhibit. Due to both parties being in agreement.
