  • Detailed information of your inquiry:
    • On Tue Jun 06, 2023 at appositely 7:52 pm the Weapon Classification Act was signed into Law through the Law Review Committee. With this act, the felony charge which was previously know as WF03 - Possession of Illegal Fireams/Weapons
      was removed and to replace that charge came a set of classes 1-4.

      Before this bill was signed into law, if someone was arrested and had in their possession a pistol .50 which was obtained illegally, they would be charged accordingly with the charge WF03 - Possession of Illegal Fireams/Weapons , which was classified as a felony charge. Now that the bill is signed into law, if someone was arrested under the same circumstances, they would be charged with WM02 - Possession of a Class 1 Firearm, a Misdemeanor.

      My question is for persons charged with the felony charge before this bill, will they have that charge adjusted to reflect the new classifications? As it does not see fair that on their record it is classed as a felony while on someone else's record after the signing of this bill, it would be classed as a Misdemeanor.

    Thank you for your request.

    Unfortunately this new act will not be retroactively changing years of past law enforcement. Before June 6th the charge of WF03 - Possession of Illegal Fireams/Weapons was a felony charge. Those caught in violation of this were charged appropriately and knew the consequence of being caught. Just because the law since has changed making this a misdemeanor charge does not excuse the actions made by individuals at the time of the previous law being in place.

    The San Andreas Judicial Branch will not be removing or amending the charges of those previously charged with a felony just because those same actions now constitute a misdemeanor charge. If you have any other questions, feel free to file another request. Thank you.
