Narrative:
I got myself into a high speed chase with the police and was eventually caught by pd, and charged for gun possession and evading. After being released from prison I went back to my house and had found out that PD had raided my apartment and taken everything from it, then charging me with gun trafficking. I disagree with the charges presented against me and I wish to dispute them. I also do not believe that pd had the authorities to raid my apartment.

    A Motion for Summary Judgement was filed in the above case on the 30th of May, 2023.


    The State of San Andreas, by and through the undersigned attorney, filed this Motion for Summary Judgement, and the reasoning for request is as follows;


    • Reasoning: Indisputable Facts
      • Detailed Explanation: An arrest was made on the 9th of April, 2023 when two officers went to release a vehicle of the defendants from impound and noticed a current warrant out for his arrest. The prosecution has shown that the defendant clearly owns the property which was breached due to a legal and Judge-approved search warrant. Within the property the officers were looking for items in connection with the crime WF03 - Possession of Illegal Firearms/Weapons. What they found and documented were in fact Illegal Firearms/Weapons. The prosecution believes there should be no dispute of the facts in this case and is therefore filing a Motion for Summary Judgement.

      The prosecution finds it very troubling that, after the amount of work put into the case, the Judge presiding over the case would question whether the defendant wishes to pursue the case. The prosecution hopes that the willingness of the defendant to continue with their case would be checked and observed prior to the posting of activation. That being said the prosecution would like it to be noted that we feel the case should continue as normal, regardless of the current wishes of the defendant as there has been ample time to rescind their want to continue with the case prior to activation.

      The prosecution is displeased by the idea of an involuntary dismissal so close to activation, especially due to lack of contact with the defendant. The idea that the prosecution has been working tirelessly, since the initial posting of this case, to ensure that, when it makes it to activation, we are accurately represented, and the defense has only taken till now to speak with the defendant or attempt to speak with them makes the Prosecution question as to whether accurate representation is being given to defendants overall.

      Numerous cases have gone occurred where a change in representation by the Prosecution, the Carl Vespucci case most recently, where the defense questioned the representation and overall work of the Prosecution on the case. The same sentiment should be applied in this case, as there was representation for Mr. Swan posted on the 18th of April. The Prosecution feels that at the very least the defense should be keeping in monthly, if not weekly, contact with the defendant to see if the want to pursue charges still exists, so we do not have cases like this where work and effort is input with no result.

      That being said, for justice to be pursued and a case to be taken to trial, both sides need to be accurately and properly represented. The Prosecution would be accepting of a continuance in an attempt to get in contact with the defendant.

    • Honorable Judge Hugh Allgood,

      We the defense respectfully respond to the prosecution's objections and reiterate the defense's motion for involuntary dismissal based on the lack of contact with the defendant.

      The defense acknowledges the prosecution's concerns regarding accurate representation and the efforts they have put forth in preparing for the activation of this case. We understand the importance of ensuring that both sides are properly represented in order to pursue justice effectively.

      However, it is essential to recognize the practicality of dismissing a case when contact with the defendant cannot be established ((Either ICLY or OOCLY)). The defense has attempted to reach out to the defendant, but unfortunately, we have been unable to make contact. This lack of communication has persisted, hindering our ability to fulfill our duty to represent the defendant adequately.

      In the interest of a fair and efficient legal process, dismissing the case is the most appropriate course of action. It would prevent unnecessary expenditure of court time and resources, given the prevailing circumstances. It is more important to prioritize cases where active engagement and cooperation from the defendant are present to ensure a smooth and just legal process.

      Moreover, as the prosecution has suggested, a continuance in an attempt to establish contact with the defendant could be considered. However, given the duration without any response, there is no guarantee that a continuance would yield a different outcome. It is better to dismiss the case at this stage and allow the prosecution to focus their efforts on cases where there is a higher likelihood of progress.

      We the defense reiterate the motion for involuntary dismissal based on the reasoning of the lack of contact with the defendant. Dismissing the case would align with the principles of fairness, efficiency, and the best allocation of court resources.

      I have tried to search the defendant's name in the MDC, and could not find it. However, I searched the defendant's phone number using the same system, and the phone number is assigned to an individual named Alexander Ashford. I was also able to locate the charges for this which case has been filed on the record. Therefore, it is the court's belief the defendant has merely changed their name, but failed to notify the court.

      I was also able to see recent citations issued to the defendant by the automated speed cameras.

      Therefore at this time, the court will be instructing defense counsel to continue attempts to reach the defendant. If the defendant cannot be reached within one week (by 12/JUN/2023), the court will then consider the motion for involuntary dismissal.

      Any response as to the defense motion for voluntary dismissal? The court is also acknowledging the prosecution has filed a motion for summary judgement. Granting the motion for voluntary dismissal would result in the appeal being dismissed and fees being assessed to the defendant for the court's time up to this point. Granting the motion for summary judgement would result in the judge doing a thorough review of the evidence and allowing both sides to make arguments. Ultimately, a verdict would be rendered, either guilty or not guilty, based on the facts as they are presented.

      As the prosecution has not filed a motion to amend charges, we the Defense feel that continuing this case would waste court time better spent on other cases. Opting for a summary judgment essentially implies acknowledging the dismissal as the ultimate resolution. In this case, the Defendant would not face any additional charges but would retain the existing ones while getting a fine.
