    • During the late evening of Feb 13th, I was responding to a multitude of 9-1-1 calls in regards to Burglary reports. Arriving on scene of many of them, there wasn't anyone in the house. I would enter the property, announce my presence, "LSPD please make yourself known" as I go through room to room clearing out each one, until the house is completely safe for the homeowner. In many instances, there were personal items left behind, or the homeowner's furniture moved from their initial location, however it would be unbeknownst to me whether there would be prints able to be taken at the time.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 20th day of April, 2023.


The case of #23-CM-0043, State of San Andreas v. Beau Bathsheba has been resolved.

On the 13th of February, 2023, members of the Los Santos Police Department were dispatched to a private residence for a reported burglary in progress. Upon arriving on scene, there were no suspects found to be in or around the location, however, officers saw a number of pieces of scratched furniture within the property that appeared to have been moved from their original locations. A detective with the Los Santos Police Department was then able to lift fingerprints off of three pieces of furniture which appear to have been moved out of place sometime during the alleged burglary. According to the detective, the fingerprints lifted from the three pieces of furniture all matched the defendant, Beau Bathsheba.

The prosecution has argued that with Mr. Bathsheba’s fingerprints being found on multiple pieces of furniture both place him at the scene and show that Mr. Bathsheba was intending to commit a crime, considering the unusual scratches on the furniture and additional missing furniture from the home.

The defense has claimed that Mr. Bathsheba was never breaking into any property that didn’t belong to him and further introduces doubt that Mr. Bathsheba is not a clean man and it would be reasonable that his fingerprints be on items of furniture that do not belong to him.

The court has found that despite the doubt introduced by the defense on the fingerprint issue, due to the defendant's fingerprints being lifted from several different pieces of furniture which appear to have been moved from their original locations inside a property that does not belong to Mr. Bathsheba, in addition to the home missing other pieces of furniture and/or items, it has been determined that Mr. Bathsheba did illegally enter the residence with the intent to commit a crime.

It is with the above considerations that I issue the following verdict:
  • On the count of GF15 - Burglary, I find the defendant, Beau Bathsheba, guilty.

In accordance with Judicial Branch policy, the defendant shall be required to pay $25,000 to both compensate the court for its time, effort, and resources expended during the case and to cover the difference in fines and sentencing between the original Robbery charge and the now-applied Burglary charge.
