Narrative:
Me and my buddy were robbing a gas station, (yes, I will admit to that) and these officers show up. We get arrested, I get my gun confiscated, and I am put in jail for a longer time than my friend. I ask the Warden to read my charges, and he tells me: Armed Robbery (correct), and Possession of an Illegal Firearm. This is not correct because I have a license for the gun I was carrying. I got charged for having an illegal gun, when the gun I had was legal. Even the guard said it was legal when he looked at my Firearm Permit.

    The Prosecution has been informed by the Los Santos Police Department that the charge WF03 - Possession of Illegal Firearms/Weapons has indeed been placed erroneously. As such, as this case has not been activated yet, we are requesting (not Motioning) this case to be dismissed and the Defendant be compensated for the time he has spent in prison for this particular charge.

A Notice of Activation was entered in the above case on 25 of January, 2023.


The case of the State of San Andreas v. Defendant is hereby activated by this Court under #23-CM-0017.

The prosecution has requested to dismiss the charge, however I cannot do so without the case being activated, docket number assigned, and a formal motion filed. Therefore I have activated this case to allow for the proper motion to be filed from the prosecution.

If the defendant wished, we can assign him representation for the short duration this case should be active.

COURT DECISION

#23-CM-0017

A decision was reached in the above case on the 28th day of January, 2023.


The prosecuting attorney in this case has filed a Motion for Voluntary Dismissal noting that the Los Santos Police Department placed the charge of WM02 - Possession of an Unlicensed Firearm incorrectly on the defendant and Mr. Ovens should have the charge removed from his record and compensated for his time spent incarcerated and the fines he paid in relation to this charge.

I will be granting this motion. This case is now closed.
