I was at the Vespucci skatepark, comforting my crying girlfriend. A dark green Cypher (occupied twice) along with a dark green motorcycle (occupied once) first drove around our parked car (Dominator ASP, LP U02Z6588, parked on South Rockford Drive) for a while and then they both pulled up next to us, stopping for a moment before circling back to our car, where they stayed for a bit and briefly left. There was also a green Kamacho tagging along.
Later they returned, the dark green Cypher parking in a nearby street (coincidentally behind our house), and the two occupants ran back to our car where the person on the dark green bike was waiting for them. The two people who were previously in the car took to picklocking the parked cars - one of them our Dominator ASP, the other one went for the orange Cypher next to it. I pulled out my gun and ran towards the individuals in an attempt to scare them off, with no intention of shooting. By that time, the person picklocking the Dominator ASP had been successful in their effort and fled in the stolen car with the person on the bike escorting them.
The other occupant of the green Cypher (who was later identified as Chloe Morningstar) kept trying to steal the orange Cypher, even after I pointed a gun at them, making me think they were armed since they did not seem to be afraid of me at all. This was also supported by the fact that they were wearing baggy clothes. They kept picking the car at first, saying: “Are you a cop? Let’s go to my friends.” This gave me reason to believe that the individual would get back up in order to hurt me, since they also seemed to be gang affiliated (driving around with multiple individuals, similar clothing and paint job on their vehicles, wearing masks). Eventually they started running towards me. I yelled at my girlfriend to call 911. I must have warned the thief at least ten times during the whole interaction, telling her to stop, pointing my gun the whole time, but she ran towards me anyway. I shot at her because I was afraid for my life, especially considering the fact that she was not afraid of my gun and seemed to be gang affiliated, with her friends most likely still roaming nearby, waiting for her to pick the car. I only shot because I was sure she had a weapon on her and was certain that my life was in immediate danger. After being shot, she ran away and tried to get into her car, when I ran closer to her she jumped from a ledge onto the lawn behind our house (several meters high) in an attempt to escape, injuring herself from the fall.
My girlfriend was on the phone with law enforcement and I also tried calling them, they arrived before we got a response from dispatch. They have ordered me and my girlfriend to drop our weapons. There was no one supervising the injured person while we were being stopped by two PD cruisers, which must have taken at least two minutes, with the woman’s friends still hanging around and one female on a bike that kept roaming the street the whole time and who I believe was on scene when it happened. I later informed officer Styll that this woman was present and that she could be a witness (she was still going up and down the street at this point, trying to see what was happening to Morningstar), but he refused to acknowledge this. I directed the officers towards the injured person so they could provide BLS (Despite the fact that I am not the one who incapacitated C.Morningstar, she fell from a very high ledge and got injured, she only had what seemed like bruises on her body, pointing to the fact that she was wearing some sort of body armor and yet nothing was found on her person, another clue pointing at the fact that she was looted by her roaming friend, she had no bobby pins on her person, despite picklocking my car just a few minutes prior to that.). I showed my license and gave my gun to officer Papadakis and told him that I shot the person, fully complying with every demand the officers had. I was detained and the person (which we found out to be Chloe Morningstar) was taken to the hospital. My girlfriend’s gun was also checked and there were no signs of it recently being shot. After Morningstar got from the hospital, the PD took her statement first. She lied and said that she was waiting for her friends in the car and that I just randomly started shooting her. Despite this making no sense, the officers seemed to be dead set on getting me charged, purely based on the fact that when they frisked her, she had no weapons, disregarding the fact that her accomplice could’ve easily taken those off of her before she was frisked since no officers were around. Then I told the officers vaguely what happened. I tried asking if I could provide a full statement but officer Styll denied me that right, saying that I’ve already told them enough (they based everything on a few snippets gathered when waiting for MD supervisors to answer on department radio, since they were already set on charging me ever since they frisked Morningstar). They also never asked my girlfriend for a statement even though she witnessed the interaction. The officers later searched Morningstar’s car and found two illegal firearms in there. This was on top of the multiple felonies she already had in the past two days. Despite this, the officers decided to charge me with assault with a deadly weapon, solely because of the fact that Morningstar did not have a weapon on her at the time of the frisk even though I’m pretty certain she was armed when I shot her and the weapon could’ve ended up anywhere, which the officers couldn’t have known since they didn’t perform a search. The officers never searched the area for any weapons Morningstar could have easily tossed away, didn’t try to investigate who the other individuals were (including the woman who was roaming the area and who the officers were made aware of by me and my girlfriend), did not even look for bullet casings. I still believe that my life was in danger since it looked like Morningstar was trying to reach into her car, where I later found out she had two illegal weapons.
I do not think I have been granted a fair process, as I never got an opportunity to give a full statement. I also offered to show my bodycam footage to the officers but they dismissed it. Officer Sebastian Papadakis offered to let me give the statement at Mission Row PD but officer John Styll refused and took me to DOC. From the moment Morningstar was frisked, the officers were determined to charge me, neglecting the investigation as a result. Morningstar’s arresting officer was Ace Butoslav, who wasn’t there for the most time and was only told the charges. The whole process was very rushed and I feel that I didn’t get a fair chance of defending myself. As a result of this neglected investigation, I’ve been charged with assault with a deadly weapon (WF01), causing me to lose both of my government jobs (Los Santos Emergency Services, Los Santos Customs) and banning me from applying anywhere else.

On 13th of September 2021, I have submitted an IA report which was concluded as : ''Following the investigation into the allegations made in the initial written complaint, the Internal Affairs Group will be concluding this particular case with the disposition of EXONERATED, meaning that the alleged act(s) did occur but were fully justified, lawful, and proper.''

        NARRATIVE
          • I responded to a back-up call from Officer Papadakis. Upon arrival he was demanding two individuals, namely Emilia Thalmer and Alex Mathers to surrender their weapons and place them on the ground. I learned that Papadakis had heard shots in the Vespucci Blvd area and these 2 individuals were the closest to the source of the gunfire. We quickly learned that the suspect had infact shot at a Chloe Morningstar who he alledged had tried to rob him. Upon searching Mrs Morningstar she was not in possession of any type of weapon. This made Mr. Mather's use of force illegal and so he was arrested and the charge placed. I will also be filing to have his firearms license revoked too.

        I would like to inform you about the full scene to the best of my ability. As I was patrolling, I heard four gunshots around State Park. Quickly after, we received a 911 call stating that a vehicle was stolen. Upon arrival we noticed two individuals approaching us. With visible weapons on their hip, we gave loud megaphone demands for them to drop their weapons. Even at the fourth demand, the individuals did not drop their firearms but we realized they were the callers as we are familiar with them due to their service with their respectful government agencies.
        They informed us about the following incident.
        They were surrounded by a few masked individuals and one of them took Emilia's vehicle.
        They then told us that there was an individual injured, behind Emily's property.
        We approached the individual and provided BLS as they decided not to treat the injured person. A medic was called and we detained both Mr. Mathers, Mrs. Emily, and the suspect named Chloe Morningstar. Mrs. Morningstar had over four active injuries at the center mass and leg area, based on the position, Morningstar appeared running down the small hill in an alley as the situation happened in the middle of the road. After the investigation, I explained above, Mr. Mathers informed us that none was armed. We searched Chloe and a medic named Korpi arrived on the scene, she was found injured due to GSW wounds. She had no items or weapons such as guns, knives, baseball bats that can harm someone. Mr. Mathers was examined and was unharmed, so was Mrs. Emily.
        In our investigation, Mr. Mathers and miss Emily had weapons on their person, Mr. Mather's weapon was hot with clear signs of discharge. Chloe Morningstar's vehicle was out of her reach, indicating that she never tried to enter her vehicle in order to retrieve a weapon. Even Mr. Mathers clarified that she did not try to harm them. She was an accessory to a grand theft auto although we had no proof of it. Based on the investigation, Mr. Mathers used unjustified force, There was no danger of great harm to him or somebody else's person which can lead to death, there were no weapons from the other parties involved as Mr. Mathers confessed and he shot someone who was attempted to flee while unarmed.

      • Due to this situation occurring many months ago, I will be making reference to my response to the LSPD Internal Affairs Group.
        - I would like to preface this statement with the following: This situation, and the charges that followed were not something that was either rushed nor taken light heartedly. In total I would estimate that myself and Officer Papadakis spent between 30 to 45 minutes both investigating the situation based on the information relayed to us from both the suspect Alex Mathers and the injured party Chloe Morningstar. We also spent a great deal of time seeking a Supervisor over the radio, however this was unsuccessful. I will now give you a summary of the events as they took place.

        I was actively patrolling when a backup call was received from Officer Papadakis. I was the only unit to respond and was not aware of what I was responding to. Upon arrival I could hear Officer Papadakis ordering an individual to surrender their weapon and place it on the ground over his megaphone. This individual was Emilia Thalmer, Alex Mathers romantic partner, once I had arrived on scene it took another 4 attempts at asking her to surrender her firearm before she complied and Alex Mathers approached her from behind. At this point Officer Papadakis had informed me that he had very recently heard shots in the area and due Miss Thalmer being the only individual he could see and her being armed he made the decision to pursue that line of investigation. It was at this point that Mr. Mathers had informed us that there was in-fact an injured person who had suffered a fall. During the next part of this situation, I located the injured person, who was discovered to be Chloe Morningstar, and immediately began to provide medical assistance. I very quickly noticed that Morningstar has sustained a number of GSW's and so the focus of my medical attention was placed on them. During the treatment that I provided Morningstar alleged that Mr. Mathers had in fact shot her multiple times and during her attempts to flea had fallen and thus sustained serious injury. Due to the nature of what I was dealing with I made the decision to call MD to the scene to assist with treating the injured individual while myself and Officer Papadakis conducted an investigation into the alleged shooting. When questioned about his actions Mr. Mathers was immediately complicit. He surrendered his firearm to us and allowed us to place him in cuffs and into the cruiser. He also had his rights read to him as per regulation. Now during the course of our investigation Mr. Mathers claimed he was not sure what the intentions of Chloe Morningstar were but that he thought she was going to try and rob him, along with 2 other unknown individuals in the area. A quick search was performed and no other individuals could be found in the immediate vicinity, nor could Mr. Mathers or Ms Thalmer provide a description of the 2 individuals. The fact of the matter is that upon searching Chloe Morningstar she was not in possession of anything that could be conceived as a weapon to any reasonable degree. Alex Mathers also admitted to both myself and Officer Papadakis that he did in fact continue to shoot at her as she attempted to flee from him also. This is why the charge of WF01 - Assault with a Deadly Weapon was placed. I deemed that Alex Mathers use of force was in fact unlawful.

        - Myself and Officer Papadakis took statements from all parties involved in the situation namely, Alex Mathers, Emilia Thalmer and Chloe Morningstar. None of the individuals named could provide bodyworn camera footage to support their version of events but one detail stood clear across every single persons statement. Alex Mathers did in fact continue to shoot at Chloe Morningstar as she attempted to flee from him. Chloe Morningstar was also not in possession of any form of weaponry either. At this point it was decided that Mr. Mather's use of force was unjustified and in fact illegal. I spent some time revising the penal code and came to the conclusion that WF01 - Assault with a Deadly Weapon was the most appropriate charge as it is described as "Assaulting another person with a so-called "deadly weapon" which could include a gun, melee weapon, or a vehicle."

    Arrest Report - I would like to see the arrest report of Miss Chloe Morningstar, the individual who was shot and arrested on scene. To gather a better understand of the whole situation and why she was also charged in the situation.

    The statement - I would like to have a written statement from Officer Ace Butoslav to explain what his witness on scene and what lead to the arrest of Miss Morning star.

    Bodycam - Footage from the officers involved at the scene. This will give us physical evidence of the situation leading to Mr Mathers arrest.

    I would like to formally oppose defense counsel's motion for discovery on grounds of relevance, and would move to have a hearing on the matter.

    Defense counsel wants the prosecution to provide evidence pertaining to the arrest of Chloe Morningstar, who is not the individual the prosecution currently has a duty to prove any elements of crimes against. The prosecution is bound to prove Alex Mathers guilty beyond a reasonable doubt.

    Additionally, the evidence the prosecution has disclosed thus far shows Ms. Morningstar was unarmed when Mr. Mathers shot her. According to Mr. Mathers's statement in his application, Mr. Mathers states PD later found weapons in Ms. Morningstar's car. True or not, this has no bearing on the charges sustained by Mr. Mathers. Also important to note, according to the evidence disclosed, PD stated Ms. Morningstar had no access to her vehicle at the time of being shot.

      • I want to preface this statement with the fact that this incident happened many months ago, but I will attempt to describe it to the best of my ability.

        The 12th of September was another day I spent with my then-boyfriend at the Vespucci skatepark, riding our BMXs. The place was familiar to us because my then-house was located very close and was a regular hang-out spot for us. I tend to get injured on a BMX quite a lot, and we were returning from the hospital where Mr. Mathers took me. He saw I was not quite myself after that hospital visit, so he asked me what was happening. I broke down crying, so we left our car parked on South Rockford Drive and walked around to the corner of the skatepark, still having a pretty good look on my Dominator ASP. I was explaining to my boyfriend how I had a man at Pillbox act very rude towards me, even going into the realm of verbal sexual harassment.

        He was comforting me, and while we were sitting next to a wall together, we saw multiple vehicles in the same paint job (I believe dark green pearlescent) circling our car, along with one other vehicle parked right next to it (belonging to other BMXers in the park). I believe the cars were a Cypher, Kamacho, and a motorcycle. The Cypher had multiple occupants, which I was able to see when it pulled up right next to us, waited for a while, and then left. I thought it was a bit weird for them to do that but eventually thought nothing of it, as some people are just nosy; maybe they just wanted to know why we were sitting against a wall.

        Eventually, me and Mr. Mathers returned to riding our BMXs. Mr. Mathers was taking a break while I continued to attempt tricks at the ramp. Eventually, I heard him shout for me to call 911. I believe he had to shout twice before I did since I had no idea what was going on, and it caught me off guard. I eventually dialed 911 and was on the phone with dispatch when I saw the bike that was present earlier next to the two cars parked on South Rockford Drive (mine and one other). I saw Ms. Morningstar run at Mr. Mathers while he had a gun pointed at her (I thought it was a man; since she was wearing a mask and very baggy clothes). I believe that at this time, my Dominator ASP was either leaving the scene or already did. Ms. Morningstar ran towards Mr. Mathers, causing him to shoot out of his legally owned gun at her. Next, I watched Ms. Morningstar run to Vespucci Boulevard towards my house. To my surprise, her car (that was previously present on the scene before they left for the first time) was parked in the parking spot behind my neighbor's house. She ended up jumping off of a very high ledge in the backyard of my house and injured herself (I know from my experience it is possible to get injured just from that, even without any GSWs, as I, unfortunately, did so myself as well).

        I ran back to the crossroad of South Rockford and Vespucci due to hearing the police sirens in order to get help. To my surprise, the officers shouted at me with megaphones to drop my weapon. I believe it took several shouts for me to do so, as it took a while for me to register why they would want me to get rid of my gun when I was on the phone with dispatch and never took it out of the holster. I was also never in this situation before (or after, for that matter). I understand this is standard procedure; I simply wish to give reasoning as to why I did not immediately unholster my weapon and throw it on the ground. I complied as soon as I realized what was going on. I believe Mr. Mathers heard the megaphone and approached the PD cruisers, telling the officers that an injured person was behind the house. I believe this was the best course of action, other than staying with injured Miss Morningstar since our only BLS kit was in the car that just got stolen, while PD is required to carry one on them and was therefore much better equipped to provide first aid. I believe that Officer Styll was providing medical attention to Ms. Morningstar while Officer Papadakis was doing the investigation. Mr. Mathers and I alerted the officers that we saw a woman on a bicycle roam around the area, stopping next to Ms. Morningstar multiple times. Still, they did nothing with this information (despite her roaming the scene even while they were investigating). I also told both officers the license plate, model, and visuals of my stolen car that the accomplices fled in, but they did nothing with this information either, as far as I am aware. Mr. Mathers and I showed the officers our weapon licenses and handed our guns to them so they could examine them and run the serial numbers. After finding out that my gun had no signs of being shot and Mr. Mathers' did, they handed both of us our guns back and the ammunition. I believe that they must have believed that Mr. Mathers did nothing wrong since they handed him back both the weapon and ammo.

        Eventually, they searched Ms. Morningstar and found no weapons on her and no illegal items. I found this very strange, considering she was just stopped in the middle of trying to lockpick a car. This could have had to do with the woman we previously alerted the officers of, but we will never truly know due to the fact that they did nothing with this information. I remember the officers asking for an MD supervisor multiple times, probably to get Mr. Mathers fired as soon as possible, even before being properly charged and the investigation being concluded. I also remember officer Styll denying Mr. Mathers' request to make a full statement, replying with something along the lines of "you already said enough" (in the snippets he said before, right after he shot someone in self-defense). I believe that Mr. Mathers also never stated that Ms. Morningstar was not armed; at most, he might have said he was not 100 % sure (as stated above, Ms. Morningstar was wearing baggy clothes). PD never explicitly took my statement, even though I was a witness. Officers also denied looking at the bodycam footage of Mr. Mathers ((his Shadowplay wasn't working, and he wasn't able to save the recording, but he wanted to RP the footage since he had valid bodycam RP)).

        I believe PD also let DOC know over department radio that they were inbound with Mr. Mathers, including his name on the radio for all of the departments to hear (I am not aware of the internal policies of PD when it comes to privacy, but that is something I wish they did not do, as it caused Mr. Mathers to be ridiculed for being a felon after he served his time by people who heard).

        I personally believed the charge was unjust, based solely on the fact that Ms. Morningstar had no weapons on her at the time of being frisked, with no assessment of whether Mr. Mathers felt his life was being threatened. It also caused him to lose both of his government jobs (LSEMS and LSC), preventing him from returning to MD for three months. While he has made incredible progress since being re-hired, he could have been even further if he was not dishonorably discharged due to this felony.
