      • Myself and Olsson were in a pursuit with other SD deputies, when Dylan followed the pursuit in a kamacho for around 3,4 minutes. we issued 2-3 verbal commands to leave, and even pulled up alongside him, and ordered him clearly to leave the pursuit line and to not follow our vehicle. He followed us for another 60 seconds or so, so we pulled them over, asked them to exit the vehicle and arrested them for failure to comply. A pistol .50 and silencer were found in the glovebox of his vehicle.

    Witness Statement
    • Myself and Lieutenant Olsson were in an active pursuit on this date, when a kamacho was following the pursuit line for an extended amount of time. I backed away towards the Kamacho, and issued verbal commands using the megaphone for the Kamacho to leave the pursuit line.

      The kamacho continued to follow, so once again we issued verbal commands, and even pulled up alongside the Kamacho and verbally requested that the kamacho leaves the pursuit line. The driver acknowledged our request, but continued following the pursuit line. At this stage, they were obstructing justice by actively getting in the way of an ongoing pursuit, so we initiated a traffic stop on the vehicle, ordering the driver to exit, and arrested them for Failure to Comply, this charge was opted for as failing to comply with our lawful order to leave the pursuit line seemed more fitting to this specific scenario than obstruction of justice.

      When the driver exited and complied, I personally searched the vehicle, as it was going to be impounded. This is when the Pistol .50 was found inside the glovebox with a silencer attached to it, so the class 1 charge, and modifications charge was added. Myself and Lieutenant Olsson both had bodycams on during this situation that can be reviewed. (( This will need to be /do's as I do not have physical footage from the day ))

ISSUANCE OF VERDICT

IN THE SUPERIOR COURT OF SAN ANDREAS

The State of San Andreas v. Dylan Deltoid
#26-BT-0017

A decision was reached in the above case on the 15th day of March, 2026.


Facts

  • Police were engaged in a pursuit when they spotted the defendant
  • The defendant was verbally warned not to follow the pursuit
  • The defendant continued to follow and was subsequently arrested.
  • Officers searched the vehicle and found an illegal firearm and modifications.

Arguments From Either Side

The prosecution argues that the defendant was given ample opportunity to stop following but did not, thereby engaging in an active pursuit. They argue that such a pursuit is an ongoing investigation, and that the defendant therefore inserted themselves and refused to stop following when told to.

The defense argues that the law requires refusal of an officer's initial orders to constitute a failure to comply, which they never documented. They believe traveling on roadways as they did was lawful and proper, and the evidence shown does not meet the court's standard for the charge of GM10 - Failure to Comply.
Verdict

The court finds that, while the defendant did indeed follow an active police pursuit for a period of time. The officer's attempts to ask the defendant multiple times, both verbally and with a megaphone, were within the full scope of issuing a lawful order. Furthermore, the court finds the order is deemed lawful pursuant to the penal code definition of VC06 - Following or Impeding Emergency Response.

The argument was made that the refusal of this order may not have been made verbally. The defendant continued following the officers during the pursuit despite warnings. In accordance with officer safety and the Penal Code, this would allow a reasonable person to interpret this as a failure to comply. The officers made multiple "good faith" attempts to warn the defendant. The subsequent traffic stop and search incident were conducted in accordance with the arrest.

It is with the above considerations that I issue the following verdict:
  • On the count of GM10 - Failure to Comply / Identify, I find the defendant, Dylan Deltoid, guilty.
  • On the count of WM02 - Possession of a Class 1 Firearm, I find the defendant, Dylan Deltoid, guilty.
  • On the count of WM03 - Criminal Use of Weapon Modifications, I find the defendant, Dylan Deltoid, guilty.
