        Narrative: Explain what happened in detail, provide sufficient detail to justify the charges. Video and image evidence can be provided. Specifically state why each charge listed was placed.
        Ms. Meleri Fox was witnessed operating a Draigur registered to herself which was idle in the high-traffic intersection west of city parking. Deputy Chief Steel followed the vehicle after it started operating towards Arcadius, and after noticing the law enforcement cruiser following, the vehicle stopped, and started several times until being pulled over on Low Power St. An unidentified male that had his hands tied behind his back hopped out of the car and approached the police cruiser. Chief Steel engaged him in conversation and he indicated that he does not know the people in the Draigur (Ms. Fox and Mr. Johnson) and that he wasn't sure if they were/would help him. The unidentified male was later tentatively identified as Darrel Heints, wanted felon who escaped from custody after a gang ambush against peace officers.

        Deputy Chief Steel approached the vehicle and identified himself as a peace officer, which prompted a verbally dismissive answer from the driver, which stated that his rank is irrelevant/not of interest to them. Deputy Chief Steel calmly explained that he identified himself as a peace officer so that they understand his orders will be lawful orders and must be obeyed. Evaluating the couple (Ms. Fox and Mr. Johnson) to be furtive, and with the possible kidnapping victim fleeing their vehicle, fearing for his safety, Deputy Chief Steel ordered the driver to exit the vehicle. This was met with immediate and belligerent pushback by the passenger who kept asking for explanations in a tone of voice which Chief Steel further evaluated as furtive.

        Ms. Fox clearly stated that she will not comply, and Chief Steel informed her that they need to comply or force will be used to remove them from the vehicle. Ms. Fox then visibly handled a .50 and its magazine during the traffic stop, which prompted Chief Steel to withdraw his service weapon and order her to step out of the vehicle immediately. Ms. Fox left the vehicle and was cuffed without further incident. Mr. Johnson was found to be in possession of controlled substances after he was searched incident to the arrest of the driver, Ms. Fox.

        Later, at Mission Row, both suspects claimed that the service carbine that was in the glovebox was in fact theirs, and following the concept of constructive possession and both their knowledge of its presence, combined with their easy access to the rifle, they were both charged with possession of a class 2 firearm.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 5th day of December, 2025.


Before moving into the details of the incident, the court acknowledges that another defense attorney presented themselves as the official attorney of the defendant. Due to the word of the defendant, stating their inability to contact their contracted attorney, and the lack of presence of the contracted defense attorney 15 minutes before as well as 15 minutes after the designated court time. The court allowed, in this specific instance, another attorney to represent the defendant, despite the prior attorney's lack of recusal and the newly appointed attorney's lack of official notice of representation. The Court would have been amenable to providing a short recess to allow the prior counsel to confer with the stand-in counsel had they arrived at any point during the trial; however, they were not present at Court for the entire trial duration.

The court officially accepts that the defendant is represented by private attorneys Michael Blaise and Izaak Scott.

The court warns all attorneys in the future of the notice presented by the Bar Association that signing on to a case and failing to provide adequate representation can result in a Bar License infraction

Moving on to the case, the Court has reviewed the incident that took place on the 19th of September, 2025, following a traffic stop conducted by the Los Santos Police Department.

The Prosecution for this case has primarily argued the fact of constructive possession following the arrest report. Prosecution has referenced the prior appeal of #23-AP-0005, Doris Murray v. State of San Andreas, which highlights the three elements required for constructive possession: knowledge, intent, and ability to possess.

The Defense argued in this case that a reasonable interpretation of the facts suggests that two individuals cannot both be charged with constructive possession of the same firearm.

The court acknowledges the concept of constructive possession as established by the Court of Appeals. The court has determined that the use of this logic was deemed to be noted when it is otherwise impossible to determine the owner through physical means, via possessions on their person.

That being said, in a case where an individual is in a vehicle, the court notes that a more appropriate representation, where multiple individuals are asserting ownership, is that the registered owner of the vehicle be the reasonable owner where knowledge of belongings is known. The registered owner of the vehicle in this case being Meleri Fox.

While constructive possession is a concept applicable to the courts, in this case, it is not necessary, as the individual owned the vehicle, was in the vehicle at the time, and admitted to possession of the firearm.

It is with the above considerations that I issue the following verdict:
  • On the count of VC13 - Disruptive Impeding or Blocking Travel, I find the defendant, Meleri Fox, guilty.
  • On the count of WM03 - Criminal Use of Weapon Modifications, I find the defendant, Meleri Fox, guilty.
  • On the count of WM02 - Possession of a Class 1 Firearm, I find the defendant, Meleri Fox, guilty.
  • On the count of WF03 - Possession of a Class 2 Firearm, I find the defendant, Meleri Fox, guilty.
